This Market Survey/Sources Sought has been issued for planning purposes only and shall not be construed as a Request for Proposal or as an obligation on the part of the Government. The Government does not intend to award a contract on the basis of the responses received to this Market Survey/Sources Sought or otherwise pay for information as solicited. Participation in this effort is strictly voluntary. The Government will utilize the information provided only to develop strategies for future requirements. All information submitted will be held in a confidential status and shall be afforded the appropriate “FOR OFFICIAL USE ONLY” protections. The Army Contracting Command – Rock Island (ACC-RI) is conducting a Market Survey/Sources Sought to identify potential sources capable of either of the following tasks: 1. Harvesting untagged Composition C4 explosive from M58 Linear Demolition Charges (DODIC M913 commonly known as the Mine Clearing Line Charge (MICLIC)) and re-blending with taggant (DMDNB). 2. Disassembly and renovation of M58 Linear Demolition Charges containing untagged C4 to the latest M58A4 configuration. Respondents should assume the scope of renovation includes replacing all components except for the unit charge assemblies (two (2) extruded pellets of C4 in a double pocket bag). SPECIAL CIRCUMSTANCES: The M58s currently being considered for use in this effort contain untagged plastic explosives (C4). The 1996 Anti-terrorism and Effective Death Penalty Act regulates possession, manufacture and transport of untagged plastic explosives within the United States. As M58s are considered military devices, they are exempt from certain regulations under the law. However, Respondents are asked to consider what impact a recycling or renovation effort might have on the “military device” designation (i.e. whether certain recycling or renovation efforts could cause a device to cease being considered a “military device”). The two (2) tasks detailed above have been successfully conducted previously, however, that was prior to the law coming into full effect in 2013. As such, Respondents are not only asked to consider and detail their technical ability to complete the described tasks, but also to address their ability to do so legally. Any non-US based Respondent should assess whether its nation is a party to the Convention on the Marking of Plastic Explosives for the Purpose of Detection (Montreal, 1991), and if so, also take into consideration any local law or regulation that may implement the requirements of that treaty. INTENT: The Government wishes to determine: - If it is feasible and cost effective to attempt reuse of previously extruded C4 either through tagging and re-extrusion or renovation of M58s that would retain untagged C4; - If reuse of C4 could de-conflict potential schedule concerns with production of explosive formulations competing for common production resources; and - If harvesting and tagging of C4 or extensive renovation of M58s can be accomplished legally. Item Description: M58A4 Linear Demolition Charge (MICLIC), DODIC M913, NSN: 1375-01-326-9642. The M58A4, commonly referred to as the MICLIC, is used to clear a path for tanks, vehicles and personnel through minefields and/or other obstacles. The MICLIC consists of extruded Composition C-4 blocks assembled along a 350-foot nylon rope/Detonator Cord Assembly. Systems would be renovated to meet requirements of Automated Data List (ADL) 2128451. The M58A4 drawings and specifications are Distribution Statement D, distribution is authorized to Department of Defense (DoD) and U.S. DoD Contractors only. Interested Contractors who would like to obtain the applicable drawings must submit a written request to the POC identified below. The written request must come from the cognizant Data Custodian of the requesting company who is registered with the Joint Certification Program (JCP). The request must include the company’s Cage/FSCM Code and Joint Certification Number. More information on the JCP may be found at http://www/dlis.dla.mil/jcp/. Interested Contractors may be required to execute and return a Non-Disclosure and/or Non-Use Agreement prior to obtaining the drawings. Contractors may obtain information on SAM registration by visiting: https://www.sam.gov. Previous M58 procurements have utilized limited competition restricted to the National Technology Industrial Base (NTIB). However, as composition C4 will be re-utilized, it is expected that future requirements may not necessarily be restricted to the NTIB. Shipping terms are expected to be F.O.B. Origin. Ammunition Data Cards (ADCs) will be required in accordance with MIL-STD-1168 and shall follow the format required by the World Wide Web application identified as WARP or Worldwide Ammunition-data Repository Program. The Contractor will be required to submit receiving reports and payment requests for delivered items in Wide Area Workflow (https://wawf.eb.mil). This application allows DoD contractors to submit and track invoices and receipt/acceptance documents electronically. Requested Information: Interested companies are invited to indicate their interest by providing the Government the following information: A brief summary of the company's capabilities and availability including: description of facilities, personnel experience, quality system, past distribution or manufacturing experience related to the items and tasks described in this notice, and satisfactory past performance in the explosives industry. Please include the business size. Description/demonstration of Respondent’s technical and manufacturing capability to harvest and tag C4 and or disassemble and renovate M58A4s. If a Respondent does not have adequate resources (facilities, technical, manufacturing, personnel, etc.) available, then they must be able to demonstrate their ability to obtain those resources without significant delay. Respondents should also indicate they are aware of the 1996 Anti-terrorism and Effective Death Penalty Act (or similar local law for non-US based respondents), understand its implications and indicate that they believe their proposed tagging and/or renovation concepts comply with the law. For renovation only: - Indicate preference, if any, for supply of M1134A4 Fuzes as Governmentfurnished material (GFM) or Contractor-furnished material (CFM); - Preferred monthly rate to deliver renovated systems; and - Preferred lead-time from contract award to first delivery. For tagging of C4 only: - Capacity for storing M58 Linear Demolition Charges; - Capacity to harvest, tag and deliver C4 as a monthly rate; and - Preferred lead-time from contract award to first delivery. Rough Order of Magnitude (ROM) unit prices for each of the below listed items. Estimated quantities are provided for planning purposes only. Cost per pound to harvest and tag C4: - 50,000 to 250,000 pounds; and - Over 250,000 pounds. Cost per unit to renovate M58s: - Up to 150 each; - 151 to 300 each; and - 301 to 600 each. What you believe would be the most appropriate type of contract vehicle to execute either of these tasks. Indication of interest in use of tagged C4 in excess of Government need for commercial purposes. If so, how much? The Government estimates there could be several million pounds of C4 that could be tagged that might be in excess of Government need. Responses: Interested parties have until May 31, 2020 to submit a response to be considered in the development of any acquisition strategy.
