Your attention is directed to FAR clause 52.219-14(e)(3) (DEVIATION 2021-O0008), LIMITATIONS ON SUBCONTRACTING, which states “By submission of an offer and execution of a contract, the Offeror/Contractor agrees in performance of the contract for General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 85 percent subcontract amount that cannot be exceeded”. In accordance with FAR 36.211(b), the following information is provided: The National Guard has no agency-specific policies or procedures applicable to definitization of equitable adjustments for change orders under construction contracts other than those described at FAR 43.204, DFARS 243.204 and AFARS 5143.204. Data for the prior 3 fiscal years regarding the time required to definitize equitable adjustments for change orders under construction contracts for the National Guard is currently not available, but will be compiled and provided in future announcements. General Description: The Contractor shall furnish all labor, materials, equipment and supervision necessary to complete the project SOW eliminating ponding water in the project area; the contractor will be responsible for performing a survey of the site and submitting a proposed grading plan for government review prior to commencing construction for the area identified on sheet 2 of the 127th CES prepared drawings. The Contractor will be required to change localized grades in the area specified in section 1.2.2. in order to provide positive drainage from sheet flow of precipitation and/or snow melt from South Perimeter Road, shoulders, roadside ditches, and adjacent vegetated spaces. The Contractor will construct a new section of South Perimeter Road, shown on sheet 9 and 10 of the 127th CES prepared drawings and the attached Army Corp of Engineers Drawings in accordance with section 5.2 and 5.5 of the project SOW. The Contractor will construct new ditches and adjust the grade of South perimeter road in accordance with the attached Army Corp of Engineers drawings. The Contractor will install (3) new 48” diameter catch basins, approximately 500 LF of Class III 18” diameter and 1100 LF of Class III 24” diameter RCP storm-sewers, and 2700 LF of 6” perforated geotextile wrapped underdrain that will tie into the existing storm water system. Brand Name Justification: N/A The projects magnitude is between $1,000,000 and $5,000,000. In accordance with FAR Part 14, 36, and FAR 19.805, the successful contractor will be chosen via Invitation for Bid procedures that result in the best value to the Government. Solicitation W50S85-23-B-0005 information will be advertised electronically on or about 16 March 2023 at Sam.gov with an anticipated award date of 6 June 2023. All responsible sources may submit a proposal which shall be considered by the agency. Award will be made to the responsible bidder whose bid conforms to the invitation for bids and is most advantageous to the Government considering only price and price related factors.
