This is published as a sole source announcement under the statutory authority at 10 U.S.C. 2304(c)(1) as implemented by FAR Part 6.302-1 --Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Army Contracting Command, Aberdeen Proving Ground, Tobyhanna Division, Tobyhanna Army Depot (TYAD), Tobyhanna, PA 18466 intends to negotiate and award a firm-fixed-price, single award, Indefinite Delivery Indefinite Quantity (IDIQ) contract on a sole source basis to Lowell Digisonde International, LLC, 175 Cabot St., Suite #200, Lowell, MA 01854. The requirement is for TYAD to acquire a minimum of one (1) each with a maximum of five (5) each DPS4D656L-1H Ionospheric Sounder Kit. Lowell Digisonde International, LLC maintains proprietary rights to the design. The Government does not have a Technical Data Package (TDP) suitable for competition for this requirement. Lowell Digisonde International, LLC is the only known supplier with proprietary rights with the requisite technical knowledge, capability, and unique insight into the manufacturing, engineering, design, integration, and system testing capabilities of the DPS4D656L-1H Ionospheric Sounder Kit. No other company can provide the required kit because the Government does not have any technical data for competition. In accordance with 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this requirement based on this notice is solely within the discretion of the Government. Any responsible firms believing they can provide the required DPS4D656L-1H Ionospheric Sounder Kit should, within ten (10) days of this notice, contact in writing the Contract Specialist identified below and submit a capability statement describing their firm’s capability to meet the Government’s requirement which will be reviewed for consideration.
