This is published as a sole source announcement under the statutory authority at 41 U.S.C. 1901 as implemented by FAR Subpart 13.5 and FAR 6.302-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Army Contracting Command, Aberdeen Proving Ground, Tobyhanna Division, Tobyhanna Army Depot (TYAD), Tobyhanna, PA 18466 intends to negotiate and award a firm-fixed price contract on a sole source basis to Lowell Digisonde International, LLC, 175 Cabot St., Suite #200, Lowell, MA 01854. The requirement is for TYAD to acquire One (1) DPS4D656L-1 Ionospheric Sounder Kit which is part of the NEXION program. Lowell Digisonde International, LLC is the only known supplier with proprietary rights with the requisite technical knowledge, capability, and unique insight into the manufacturing, engineering, design, integration, and system testing capabilities of the DPS4D656L-1 Ionospheric Sounder Kit. No other company can provide the required kit because the Government does not have any technical data for competition. In accordance with 41 U.S.C. 1901 as implemented by FAR Subpart 13.5 and FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Only new items will be accepted. Refurbished, remanufactured, reconditioned, overhauled, grey market or used items are not acceptable. TYAD requires the Sounder Kit be delivered no later than 120 days after receipt of order. Equipment shall be delivered to the following address: Tobyhanna Army Depot ASRS Receiving, Bldg. 1C Bay 6 11 Hap Arnold Blvd. Tobyhanna, PA 18466-5091 Request for proposal (RFP) W25G1V-20-R-0007 will be issued on or about January 29, 2020. Actual issue due dates shall be established in the solicitation. The RFP will be available for download on BETASAM website. Vendors wishing an electronic copy may download the RFP on or after the issue date at the following internet address: beta.sam.gov, Keyword/Solicitation Number, insert W25G1V-20-R-0007 and click SEARCH. The solicitation will be issued electronically only. No paper or disc copies will be issued. Any resultant contract shall be Firm-Fixed Price In order to be eligible for award, the prospective offeror must have a current and active registration in beta.sam.gov and not show any Active Exclusion and not have Debt Subject to Offset. The Offeror must be found responsible in accordance with FAR 9.1 – Responsibility of Prospective Contractor. This notice of intent is not a request for a competitive proposal. A determination by the Government not to compete this requirement based on this notice is solely within the discretion of the Government Any responsible firms believing they can provide a the required Sounder Kit should within (15) days of this notice, contact in writing the Contract Specialist identified below and submit a capability statement describing their firm’s capability to meet the Government’s requirement which will be reviewed for consideration.
