The U.S. Army Contracting Command-New Jersey, Picatinny Arsenal, NJ 07806-5000, on behalf of Project Manager Soldier Weapons-Soldier Lethality, intends to solicit, negotiate and award a sole source contract to Saab Dynamics AB, Karlskoga, Sweden pursuant to the authority of Title 10 United States Code (USC) Section 2304(c)(1), as implemented by Federal Acquisition regulation (FAR) 6.302-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Saab Dynamics holds all data rights to the Carl Gustaf M3 rifle and it’s a variant systems. The contemplated sole source contract will be Firm Fixed Price (FFP) for a period of performance of five (5) years with two (2) option years from date of contract award. The procurement is for the M3E1 Lightweight 84mm Carl Gustaf rifles is in support of the Multi-Role Anti-Armor Anti-Personnel Weapon System (MAAWS) program. The Carl Gustaf M3E1 MAAWS is a variant of the Carl Gustaf Multi-Role Anti-Armor Anti-Personnel Weapon System (MAAWS) (going forward will be referred to M3E1 MAAWS) which is a shoulder-mounted recoilless rifle with Rounds Counter Software for maintenance support device and accessories that fires a family of 84mm anti-personnel, anti-tank, anti-structure, smoke, and illumination rounds. The Carl Gustaf M3E1 weapon is 16% lighter than the Carl Gustaf M3 rifle previously procured. It also includes, improved ergonomics, impact protection, backup reflex sight, and an electronic round counter to reduce lifecycle cost. The weapon system will be built to the contractor’s technical data package (TDP). The Government did not choose to purchase technical data rights at the program’s inception due to the anticipated cost of the rights on a potentially short lived program supported only by operational needs statements. Saab Dynamics developed, owns, and claims the data rights. The MAAWS cannot be procured competitively utilizing a technical data package. Until a TDP is made available, it is likely that award to any other source is not likely as it would and be detrimental to mission readiness and Warfighters safety. Saab Dynamics is the only source able to meet the Government's MAAWS program requirements within the necessary timelines. Any responsible source may submit a capability statement, proposal and/or quotation not to exceed five (5) pages that will satisfy this requirement, which shall be considered by the Agency. A response submission should be received by Margaret Reed, Contract Specialist No Later Than 13 March 2020. The applicable NAICS code is 332994.
