NOTICE OF PROPOSED CONTRACT ACTION The Government intends to negotiate with only one source, Mid Atlantic Machinery, for the procurement of one, Brand Name Only (BNO) Trumpf TruDisk 3022 (FD31), a 515nm 3kW Fiber Coupled Disk Laser, under the authority, 41 U.S.C. 1901 as implemented by FAR 13.106-1(b)(1)(i), which states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available. As confirmed through the Original Equipment Manufacturer's (OEM), Trumpf, Mid Atlantic Machinery, a small business, is the only authorized US-based distributor of the BNO Trumpf TruDisk 3022 (FD31). This is not a request for competitive quotes; however, all responsible sources may submit a quote which shall be considered by the agency. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The resultant contract action will be firm-fixed price. Verbal requests will not be acted upon. The North American Industry Classification System (NAICS) Code is 333517.
