The government requires 100 units of a part delivered FOB origin, but the item requires engineering source approval by the design control activity because the approved source(s) hold essential data rights, manufacturing/repair knowledge, or technical data not economically available to the government. Alternate sources must qualify under procedures approved by the cognizant Government engineering activity. Award will be made only if the offeror, product/service, or manufacturer meets the qualification requirements at time of award under FAR 52.209-1. One or more items may be subject to Free Trade Agreements and the WTO Government Procurement Agreement if the relevant DFARS clauses are included.
