Reference is made to Special Notice for Sole Source Purchase Order (Notice ID SP3300-22-Q-0047), published to SAM.gov on May 19, 2022. This notification is being published to incorporate a copy of the redacted Limited (Sole) Source Justification Memo, resulting from award of purchase order SP3300-22-P-0686. The original anticipated period od performance was changed from six to ten months. The original Special Notice read as follows: "Notice of Intent to Award a Sole Source Purchase Order DLA Distribution intends to solicit only from one source and award a purchase order to Tracy Delta Solid Waste Management, Incorporated, under the authority of FAR 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements (Citation: 10 U.S.C. 2304(c)(1))”, for a period six months. DLA Distribution has a requirement for Unitized Group Rations (UGRs) food disposal service in support of the UGRs Mission at DLA Distribution San Joaquin, CA (DDJC). The UGR Mission is to supply multiple, different type meals that are ready to heat and serve to the armed forces in the field in Afghanistan, Iraq, and in the Continental United States (CONUS.) DDJC does not have the necessary equipment needed to transport and dispose food waste to their designated landfill. Lack of appropriate food disposal is causing an accumulation of waste at DDJC, which is impacting their mission. This is a new procurement for transportation and disposal service of boxed/packed damaged food items and other organic waste. Due to San Joaquin County Ordinance (San Joaquin Code, Title 5, Division 2, Chapter 7 5-2702) and California State Regulations (under Senate Bill (SB) 1383 effective January 1, 2022), availability from compliance vendors is limited. San Joaquin County Ordinance designated the Tracy Transfer Station and Materials Recycling Facility (dba Tracy Material Recovery and Solid Waste Transfer, Inc.) located in Tracy, CA as the only recipient of waste generated by and collected from DDJC. Additionally, due to the immediate need for the transportation and disposition of accumulated food waste at DDJC, it is imperative to award a short-term PO for such services to avoid any health hazard to onsite personnel or any violation of sanitary regulations. Tracy Delta Solid Waste Management, Inc. is the only vendor with the ability, technical familiarity, equipment on-hand, and personnel to perform all required services (transportation, disposal, and container) in accordance with county and state organic waste management regulations within a short period of time. Using another vendor or contractor is not in the Government’s best interest, won’t comply with county ordinance and SB 1383 organic waste requirements, would create unacceptable delays in fulfilling the agency's requirement, and could negatively impact the UGRs Mission at DDJC. The North American Industry Classification System (NAICS) code for this effort is 562111 with a small business size standard of $41.5 million. The Federal Supply Code (FSC) for this acquisition is S205. This notice of intent is not a request for competitive quotations. This synopsis is for informational purposes only.
