This is not a formal Request for Quote (RFQ) or proposal (RFP). Responses in any form are not offers and the Government is under no obligation to award a contract as a result of this announcement. United States Special Operations Command (USSOCOM) has the need to incorporate (via contract modification) three additional Ordering Periods (OP) into our current Indefinite Delivery, Indefinite Quantity (IDIQ) contract, H92222-17-D-0016, for the continued sustainment and De-Militarization of the legacy JEM (AN/PRC-148 (v)(5/(v)6) and the MBITR (AN/PRC-148B (v)(5/(v)6)) Radios with Thales Defense & Security Inc., 22605 Gateway Center Dr., Clarksburg, MD 20871-2001. As previously announced in the Request for Information (RFI), (RFISUSTAIN) posted on 30 Jun 2021, in September 2015, L3Harris was competitively selected to produce the SOF Next Generation Handheld Radio (NGHH), PRC-163, which is the replacement for all legacy radios. However, due to delays encountered with the NGHH Radio (PRC-163) program, SOCOM was not able to begin replacing these Thales legacy HH radios until FY20 vs. FY17 as originally planned. Additionally, recent COVID 19 transportation issues and forced telework situations have only worsened this situation. Given the delays and the current budget, it would not be feasible to conduct a full Capital Equipment Replacement Program (CERP) by the end of the current contract’s expiration date of 30 September 2021. Therefore, until such time as all legacy radios can be replaced with the NGHH and Full Operational Capability is achieved, sustainment of these legacy radios will still be required. Thus, it is necessary to increase the original 5-year OP by three years for a new total of eight OPs to fully execute the CERP of the these legacy HH radios. The current contract maximum ceiling value of $9.9M will remain unchanged. The modification will be executed under the authority of FAR 6.302-1(a)(2)(ii), only one source is capable of satisfying the agency's requirements. This determination is based on the fact that Thales is the original equipment manufacturer (OEM) and sole provider of the MBITR Radios. Per FAR 5.207(c)(16)(ii), all responsible sources may submit additional capability statements that will be considered by the agency. Any party responding to this notice shall send clear, factual documentation demonstrating their ability to execute this requirement.
