The Naval Air Warfare Center Aircraft Division (NAWCAD), Patuxent River, MD intends to negotiate and award a sole-source Basic Ordering Agreement (BOA) to L3Harris Technologies, Inc., 2400 Palm Bay Road NE, Palm Bay, FL 32905-3377 for the procurement of production support activities of the Fibre Channel Network Switch (FCNS). The FCNS is currently used on the F/A-18E/F, EA-l8G, and E-2D aircraft. The FCNS production support activities include: system analysis and feasibility studies in support of Engineering Change Proposals (ECPs) and new applications; reliability, maintainability, and logistics engineering; program management, systems integration, and oversight; engineering investigations/studies; system qualification and testing for configuration and obsolescence management; hardware integration and documentation for the FCNS. This acquisition is being pursued on a sole-source basis under the authority of 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) Part 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. L3Harris is the only source that can fulfill the FCNS production and support requirements. The technical data, along with an understanding of the internal design and functional requirements of the FCNS are necessary to allow for production and support that meets the overall performance requirements. The FCNS design is based on a commercial product L3Harris sells for commercial aviation use. As such, the Government did not procure detailed internal design specifications or interface data packages sufficient for a third party to redesign individual components within the FCNS. This approach requires the supplier to repair, modify, or integrate components within the currently designed FCNS. L3Harris will not sell data rights to the proprietary portions of its designs. In addition, L3Harris as the Original Equipment Manufacturer (OEM) is the sole company with the requisite test equipment and software to perform the required testing after any design modifications have been made. The Government does not intend to fund the development or qualification of other sources for fulfilling this requirement. All responsible sources may submit a capability statement, which shall be considered by the agency.
