Performance Work Statement Musician Coordinator for the Fort Benning Garrison Chaplain Office 1.0 General Information: 1.1 SCOPE OF WORK: The contractor shall provide all personnel and supervision as necessary at various locations at Chattahoochee and Muscogee Counties, Fort Benning, Georgia, to perform duties as the Musician Coordinator. 1.2 BACKGROUND INFORMATION: The mission of the Garrison Chaplain's Office is to provide military religious support and activities that meet the religious requirements of Soldiers, Families and authorized DoD Civilians. The primary goal of the Garrison Chaplain is to ensure the free exercise of religion, mandated by United States Code (USC) Title 10 and the Resource Management Directorate (RMD) User Guide. 1.3 PERSONNEL: 1.3.1. Contractor shall be computer literate with knowledge of word processing, database, and spreadsheet software. 1.3.2. RESERVED 1.3.3. The Government has the right to restrict the employment under this contract of any Contractor employee, or prospective Contractor employee, who is identified as a potential threat to the health, safety, security and general wellbeing or operational mission of the installation and its population. 1.3.4. The Contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest, nor shall the Contractor employ any person who is an employee of the Department of the Army, either military or civilian, unless such person seeks and received approval in accordance with Department of the Army (DA) policies and Standards of Ethical Conduct Rules. In addition, the Contractor shall not employ any person who is an employee of the Department of the Army if such employment would be contrary to the policies contained in Department of Defense Directive (DoDD) 5500.7-R. 1.3.5. The Contractor is cautioned that military personnel hired under this contract are subject to permanent change of station or deployment. Their absence at any time shall not constitute an excuse for non-performance under this contract. 1.3.6. All personnel employed by the Contractor in the performance of this contract, or any representative of the Contractor entering the Government reservation, shall abide by all the regulations of the installation which may be in effect during the contract period. 1.3.7. Contractor shall perform a local law enforcement background check on any employees that work directly with children and youth before any units of services are performed. If the employees are military retirees or dependents, then employees could obtain a Fort Benning Military Police background check. Background checks verifications must be provided to the Contracting Officer within 14 days after contract award. 1.3.8. Contractor must inform the Contracting Officer or Contracting Officer Representative (COR) of any changes in any employees before any unit of service is performed. 1.3.8.1. The Contractor shall ensure all requirements of this contract are met and interface with the COR. The Contractor shall be available 30 minutes prior to scheduled work hours and within 2 hours when contacted after work hours. 1.3.8.2. The contractor shall be available on weekdays and weekends and shall provide the Contracting Officer and COR with contact information in case of emergency. A musician not able to play at worship may constitute an emergency. The contractor shall have a plan in place to remedy such emergencies. 1.3.8.3. The contractor shall submit a hardcopy Certification Sheet of the invoice to the presiding Chaplain for signature and verification of services rendered and quality of work. The contractor shall submit the signed Certification Sheets with a consolidated invoice to the COR not later than the 5th day of a month for the preceding month's service. All invoices shall be digitally submitted through Wide Area Workflow at https://wawf.cb.mil / by the same date. 1.3. QUALITY CONTROL 1.3.1. The contractor shall establish and maintain a Quality Control Plan (QCP) to ensure that the requirements of the contract are provided as specified. An updated copy shall be provided to the Contracting Officer and COR as changes occur. The plan shall include the methods of identifying and preventing defects in the quality of service performed before the level of performance becomes unacceptable. The QCP shall be provided to the Contracting Officer and COR within ten (10) workdays following contract award. 1.3.2. As part of the contractor's quality control system, the contractor shall maintain on-site records of all inspections conducted by the contractor and any necessary corrective action(s) taken. These records shall be made available to the Government upon request at any time during the term of the contract. 1.3.3. The Contractor shall turn-in the Quality Assurance Checklist to the COR for each employee every month. 1.4. SAFETY REQUIREMENTS: The Contractor shall comply with Occupational Safety and Health Act (OSHA) and all pertinent provisions of the publication 29 CFR 1910, and EM 385-1-1, Safety and Health Requirement Manual. 1.4.1. Personnel Safety. 1.4.1.1. The Contractor shall perform work requirements in a manner to protect employees from any harm or injury. Work shall be scheduled to afford this protection. 1.4.1. 2. The Contractor shall immediately correct all safety deficiencies. 1.4.2. Accident Protection and Emergency Medical Treatment. Medical services for Contractor personnel are the responsibility of the Contractor; however, on an emergency basis, the Government will provide medical services for job-related injuries while an employee is performing under this contract. Such emergency medical care will be limited to those services necessary to prevent undue suffering or loss of life and will be provided only during the period of the emergency. In such circumstances, the contractor shall transfer injured employees to a health care provider as soon as the emergency period ends. The Contractor shall reimburse the Government for emergency medical services provided upon receipt of invoice from the medical facility. Medical facilities are located at Martin Army Community Hospital, Fort Benning, GA. 1.5 QUALITY ASSURANCE REQUIRMENTS: (Coordinate with section 1.3) 1.5.1 Quality Control (QC): The contractor shall develop and maintain an effective QC program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor's QC program is the means by which the contractor assures its work complies with the requirement of the contract. After acceptance of the QC plan, the contractor shall receive the Contracting Officer's acceptance in writing of any proposed change to his QC system. 1.5.2 Quality Assurance: The government will evaluate the contractor's performance under this contract in accordance with the quality assurance surveillance plan. This plan is primarily focused on what the government will do to ensure the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rates. 1.5.3 Government Remedies: The Contracting Officer will follow Federal Acquisition Regulation (FAR) 52.212-4, Contract Terms and Conditions-Commercial Items, and FAR 52.246-4, Inspection of Services-Fixed Price, for a contractor's failure to perform satisfactory services or failure to correct non-conforming services. 1.5.4 Recognized Religious and Federal Holidays: The services will be provided predominantly on Saturdays/Sundays and other religious and Federal holidays. Special and holiday services may include but not limited to, New Year's Day, Martin Luther King , Jr. Birthday Presidents Day, Psalm Sunday, Good Friday, Easter, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving, Christmas Eve, Christmas Day, and New Year's Eve. In addition, memorial/funeral services may be required as an on-call basis with two (2) days notification. Memorial/funeral services include estimated twenty-five (25) services per year with a minimum of a pianist. 1.5.5 Hours of operation or place of performance: The contractor is responsible for conducting services at various hours, Monday through Sunday except federal holidays or when the government facility is closed due to local or national emergencies, administrative closings, or similar government-directed facility closings. The contractor shall at all times maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the government facility is not closed for the above reasons. When hiring personnel, the contractor shall maintain stability and continuity within its work force. 1.5.6 SCHEDULE OF SERVICES Contractor shall coordinate the schedule of those services requiring rehearsal as well as the locations upon contract award. Rehearsals will not be required for every service. Rehearsals shall be required for memorials and other special events. 1.6 SECURITY REQUIREMENTS: 1.6.1 Contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by the government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by Installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes. 1.6.2 All contractor employees, to include subcontractor employees, requiring access Army installations, facilities and controlled access areas shall complete AT Level 1 Awareness Training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within 30 calendar days after completion of training by all employees and subcontractor personnel. AT level I training is an annual requirement if option years are exercised. 1.6.3 Access and General Protection/Security Policy and Procedures. Contractor and all associated subcontractor employees shall comply with applicable installation, facility, and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes. 1.6.4 iWATCH Training. The Contractor and all associated sub-contractors shall brief all employees on the local iWATCH program in coordination with information provided by the COR. This local developed training shall be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 30 calendar days after contract award. 1.6.5 OPSEC SOP/Plan. The contractor shall adhere to the Government's Operations Security (OPSEC) Standard Operating Procedure (SOP)/Plan during the entire period of performance. 1.6.6 In accordance with AR 530-1, all personnel shall complete Level I Operations Security (OPSEC) training which is composed of both initial and continual awareness training (annually). All newly assigned personnel, within the first 30 days of arrival in the organization, shall receive initial training to include a briefing on the organizations critical information. The end state of initial and continual awareness training is that each individual should have the requisite knowledge to safeguard critical information. 1.6.7 Physical Security. The contractor shall be responsible for safeguarding all government property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured. 1.6.8 Contractor Employees Who Require Access to Government Information Systems: All contractor employees, and associated subcontractor employees, with access to a government information system must be registered in the ATCTS (Army Training Certification Tracking System) at commencement of services and must successfully complete the DoD Cyber Awareness Challenge training prior to access to the information system and then annually thereafter. 1.6.9 Conservation of Utilities. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities which includes turning off the water faucets or valves after using the required amount to accomplish the necessary cleaning. 1.6.10 Post-award conference or periodic progress meetings: The contractor agrees to attend any post-award conference convened by the contracting activity or contract administration office. These procedures are identified in FAR Subpart 42.5. The Contracting Officer, COR, and other government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the Contracting Officer will apprise the contractor of how the government views the contractor's performance, and the contractor shall apprise the government of any problems experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government. 1.6.11 COR: The COR for this contract is the FBGA Chaplain Resource Manager, located at 1 Karker Street, Suite 3200, Fort Benning GA. 31905. The COR shall monitor all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure the contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, monitor contractor's performance and notify both the Contracting Officer and contractor of any deficiencies; coordinate availability of government-furnished property; and provide site-entry for contractor personnel. A letter of designation will be issued to the COR, a copy of which will be sent to the contractor detailing the responsibilities and limitations of the COR. The COR is not authorized to change any of the terms and conditions of the contract. 1.6.12 Contract Manager: The contractor shall manage the contract or shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor during absences shall be designated in writing and provided to the Contracting Officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. 1.6.13 Identification of Contractor Employees: All contract personnel attending meetings, answering government telephones, and working in other situations where their contractor status is not obvious to third parties shall be required to identify themselves as contractors to avoid creating an impression in the minds of members of the public that they are government officials. They shall also ensure all documents or reports produced by the contractor are suitably marked as contractor products or that contractor participation is appropriately disclosed. 1.6.14 Telephone Usage: Contractor employees shall not use Government telephones at the work site for personal reasons or make any toll or long distance calls. 1.6.15 For contractors that do not require CAC, but require access to a DoD facility or installation; Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations. 1.7 BACKGROUND CHECK REQUIREMENTS: (Coordinate with paragraph 1.3.7) Contractor/Sub-Contractor employees providing services under contracts are subject to the following process: 1.7.1 Each employee (direct employee and sub-contractor employee) working under this contract who has contact with children under 18 years of age, shall be screened with the appropriate background checks as governed by the Army Directive 2014-23 "Conduct of Screening and Background Checks For Individuals Who Have Regular Contact With Children in Army Programs", dated 10 September 2014. A copy of the Army Directive can be found at http://www.apd.army.mil/pdffiles/ad2014_23.pdf. The background check requirements for Contractors can be found in Enclosure 3 - Screening and background checks for appropriated and non-appropriated fund personnel, military personnel, foreign national employees overseas, and contractors. 1.7.2 Background checks will be initiated and paid for by the Government. The cost for the pre- employment screening is the responsibility of the Contractor. The Commander Designated Entity (CDE) at the Installation supports IMCOM by coordinating, submitting, tracking child related background checks, and reviewing and compiling the results to identify whether they contain derogatory information to be passed on for a suitability determination. The CDE will advise and assist CONTRACTOR and sub- CONTRACTOR employees completing all required documents required for the background check process. CDE contact information will be provided upon contract award. Each employee (direct employee and sub-contractor employee) working under this contract who has contact with children under 18 years of age, shall be screened with the appropriate background checks as governed by the Army Directive 2014-23 "Conduct of Screening and Background Checks For Individuals Who Have Regular Contact With Children in Army Programs", dated 10 September 2014. (this is included in the firm fixed price 1.7.3 The following is a list of the required screenings per the Army Directive 2014-23. 1.7.3(A) REGULAR/RECURRING contact with children: Definition: Contact with children more than an average of one (1) day a week for three (3) or more months OR daily for a period of one (1) month or longer. Required screening: •i) Pre-employment screening: 1) Application, 2) Interview, 3) Reference check, 4) Statement of Previous Arrest or Charge, 5) Assessment of individual's eligibility, qualifications, temperament and suitability for work with children, 6) Tentative offer of employment (Proponent: Contractor is responsible organization); •ii) Preliminary investigation: 1) Installation Record Check (if applicable), 2) FBI Fingerprint check, and 3) Local Civilian Law Enforcement Check (Proponent: Government/Commander Designated Entity is responsible organization); •iii) CNACI - Child Care National Agency Check and Inquiries (Proponent: Government/Commander Designated Entity is responsible organization). The CNACI will be initiated after successful completion of the preliminary investigation (1.3(a) (ii)). If deemed appropriate by the local Garrison Commander, a contractor can start working under Line Of Sight Supervision (LOSS) after successfully completing the preliminary investigation (1.3(a) (ii). If LOSS is not feasible, favorable CNACI (1.3(a) (iii) results are required BEFORE the contractor can start working under this contract. 1.7.3 (B) SHORT TERM/OCCASIONAL contact with children: Definition: Contact with children that does not fall under the definition of Regular/Recurring contact. Required screening: •i) Pre-employment screening: 1) Application, 2) Interview, 3) Reference check, 4) Statement of Previous Arrest or Charge, 5) Assessment of individual's eligibility, qualifications, temperament and suitability for work with children, 6) Tentative offer of employment (Proponent: Contractor is responsible organization); •ii) Preliminary investigation: 1) Installation Record Check (if applicable), 2) FBI Fingerprint check, and 3) Local Civilian Law Enforcement Check (Proponent: Government/Commander Designated Entity is responsible organization); An employee must successfully complete the required screening (1.3(b)(i) and (ii) BEFORE Working under this contract •1.7.4 No person, regardless of circumstances, will be approved to provide child care services if the individual has been convicted of a sexual offense, a drug felony, a violent crime or a criminal offense involving a child. If the background check investigation reveals any other derogatory information a suitability determination has to be made by the Army. The adjudication of derogatory information is processed through an Army Program Review Board (PRB). Further details about the adjudication process can be found in Enclosure 6 of the AD 2014-23. At any time a Contractor can decide not to proceed with the PRB process. 1.7.5 Additional information on the background check process can be found at: http://www.opm.gov/investigations/background-investigations. •1.7.6 Re-verification (IRC and FBI fingerprint check) is required every 5 years. 1.8 ENVIRONMENT AND OSHA: The Contractor shall comply with all local, State, and Federal environmental and occupational safety laws, rules, and regulations. Any apparent conflict with the requirements of the contract shall be brought to the attention of the Contracting Officer for final resolution. The Contractor shall notify the Contracting Officer and COR in writing, in addition to any verbal notification, of such conflicts. The Contractor shall be liable for all fines, penalties, and costs that result from violations of, or failure to comply with, all such local, State, or Federal laws, rules, and regulations. All unsafe acts or conditions fostered by the contractor or contractor personnel may be grounds for the Contracting Officer or the COR to halt work with a commensurate deduction of monies due the Contractor until such unsafe conditions are corrected. The contractor shall take due caution not to endanger personnel during the performance of this contract. Upon discovery of a serious hazard such as fires, or a large fuel spill, the Contractor shall notify Fort Benning Fire Department and the COR. 1.8 The contractor shall immediately correct all safety deficiencies identified by the Contracting Officer and/or COR, and shall notify the Contracting Officer and COR of the corrective action taken. 1.9 CONTRACTOR Manpower Reporting 1.9.1 Accounting for Contract Services/Contractor Manpower Reporting (UNCLASSIFIED) 1.9.2 The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including sub-contractor manpower) required for performance of this contract. The contractor is required to completely fill in all the information in the format using the following web address "https://contractormanpower.army.pentagon.mil". The required information includes: •§ Contracting Office, Contracting Officer, Contracting Officer's Technical Representative; •§ Contract number, including task and delivery order number; •§ Beginning and ending dates covered by reporting period; •§ Contractor name, address, phone number, e-mail address, identity of contractor employee entering data; •§ Estimated direct labor hours (including sub-contractors); •§ Estimated direct labor dollars paid this reporting period (including sub-contractors); •§ Total payments (including sub-contractors); •§ Predominant Federal Service Code (FSC) reflecting services provided by contractor (and separate predominant FSC for each sub-contractor if different); •§ Estimated data collection cost; •§ Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the contractor with its UIC for the purpose of reporting this information); •§ Locations where contractor and sub-contractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website); •§ Presence of deployment or contingency contract language; and •§ Number of contractor and sub-contractor employees deployed in theater this reporting period (by country). As part of its submission, the contractor will also provide the estimated total cost (if any) incurred to comply with this reporting requirement. 1.10.3 Reporting period will be the period of performance not to exceed 12 months ending September 30 of each government fiscal year and must be reported by 31 October of each calendar year. Contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML direct transfer is a format for transferring files from a contractor's systems to the secure web site without the need for separate data entries for each required data element at the web site. The specific formats for the XML direct transfer may be downloaded from the web site. 2.0 DEFINITIONS AND ACRONYMS: 2.1 DEFINITIONS 2.1.1 Contract Manager: The Contractor or his representative who will manage the services of this contract. 2.1.2 Contracting officer's representative (COR): A representative from the requiring activity appointed in writing by the Contracting Officer to perform surveillance and to act as liaison to the contractor. 2.1.3 Defective service: A service output that does not meet the standard of performance associated with it in the PWS. 2.1.4 IWATCH Training: The Army's "See Something, Say Something" Training 2.1.5 Quality Assurance Surveillance Plan (QASP): A written document specifying the surveillance method used for surveillance of contractor performance. 2.1.6 Quality Control (QC): Actions taken by a contractor to control the performance of contracted services to meet PWS requirements. 2.1.7 Quality Assurance: Actions taken by the government to assure contracted services meet PWS requirements. 3.0 GOVERNMENT-FURNISHED ITEMS AND SERVICES: 3.1 General: The government will provide the equipment, utilities and facilities listed below. 3.2 Equipment: The government will provide: a piano, keyboard, electric organ, guitar and/or one (1) digital, multi-instrument and capability keyboard for the appropriate Chapel. These instruments are already in place. 3.3 Utilities: All utilities in the facility will be available for the contractor's use in performance of duties outlined in this PWS. The contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities. 3.3 Facilities: Access will be granted to the applicable chapel service for rehearsals, if required, and services. 4.0 CONTRACTOR-FURNISHED ITEMS AND SERVICES: Contractor-Furnished Items: The Contractor shall furnish materials other than that specified as Government Furnished in 3.0 above. Contractor shall provide its own transportation. These expenses shall not be reimbursable by the Government. 5.0 Specific tasks 5.1 Basic Services: The contractor shall provide live, quality instrumental music for worship services and rehearsals as required by the Senior Pastor Chaplain of each service according to the needs of that congregation. The majority of worship services are scheduled for Saturday or Sunday at one of the Fort Benning Chapels or designated government facilities. In addition to the normal scheduled worship services, the contractor shall provide for occasional Special Services and Memorials as required in accordance with AR 165-1 and USC Title 10. 5.1 Qualifications OF Musicians 5.1.1 The Musician Coordinator shall provide qualified musicians with at least three (3) professional references from within last three (3) years who can confirm the musician's musical and personal excellence while serving as the primary musician in a recurring worship service. Musicians without experience in a worship setting may be considered if the criteria for references and musical abilities can be met. Each reference shall also verify their own credibility as a professional musician, clergy, etc. in a recognized church setting or applicable setting. Note: This requirement may be waived at the discretion of the COR depending on the musician's performance abilities. The COR is the designated authority for all music selections and retains the right to evaluate the quality of the services described herein. The COR will indicate upon award which two (2) locations have the organ as the primary instrument for musical accompaniment. 5.1.2 The musicians provided by the Coordinator shall be grouped under the following classes based on their level of education and experience and the level of services provided. CLASS CRITERIA A Less Experience, No Rehearsal B More Experience, No Rehearsal C Advanced Degree, No Rehearsal D More Experience with Rehearsal E Advanced Degree with Rehearsal 5.1.3 Each musician shall be able to sight read music and demonstrate musical proficiency on the piano/keyboard, and for the electric organ if used as the primary instrument for leading worship. 5.1.4 Contractor shall present a professional and neat appearance at all times and conduct shall not reflect discredit upon this installation or the Department of the Army. 5.2 SPECIFIC Tasks Musicians: 5.2.1 Worship services that require rehearsals will be predetermined by the Senior Chaplain for that location. In the event that a rehearsal is required, the musician shall be required to provide 60 minutes for music rehearsal prior to the worship service; prepare music for warm-up of choir/soloist voices to ensure readiness for worship service; play preludes, postludes, offertory music, accompany congregational singing and special music; provide cues for soloist or small groups in singing special music as needed; select music appropriate for church season or to support sermon topics, if requested, for each worship service in conjunction with the presiding Chaplain; and ensure that all music selections and mode of distribution/display comply with applicable copyright laws.
