This Sources Sought notice is being posted to satisfy the requirement of Defense Federal Acquisition Regulation Supplement (DFARS) 206.302-l(d). The Naval Air Warfare Center, Aircraft Division, Lakehurst, New Jersey intends to issue a Sole Source, Firm Fixed Price contract to Total Quality Systems, Inc. (TQS) (CAGE 020U3) for the procurement of Maintenance and Support Services for Intermittent Fault Detection and Isolation System/Joint Intermittence Tester (IFDIS/JIT) stations and their associated Test Program Sets located at FRC West (FRCW) Lemoore, FRC Mid-Atlantic (FRCMA) Oceana, and FRC Southwest (FRCSW) North Island. The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1, 10 U.S.C. 3204(a)(1) “Only one responsible source and no other supplies or services will satisfy agency requirements” for this action. TQS has the SBIR data rights to make any diagnostics, modifications, upgrades or repairs to the IFDIS/JIT units. Due to this fact, TQS is the only contractor with the data rights necessary to service the IFDIS/JIT. The Government does not have the data rights for this part to allow for a competitive procurement. (THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS). The Government will consider all information received prior to the closing date of this notice. A determination by the Government not to compete this procurement based upon responses to this notice is solely within the discretion of the Government. The Government will not pay for any responses received. There are no commitments by the Government to issue any solicitations, make an award or awards, or to be responsible for any monies expended by any interested parties before award of a contract for the efforts mentioned above.
