The Naval Air Warfare Center, Aircraft Division, Joint Base McGuire-Dix-Lakehurst, NJ (NAWCADLKE) intends to negotiate on a sole source basis with Tel-Instrument Electronics Corp located in East Rutherford, New Jersey who is the original equipment manufacturer, designer, developer, and manufacturer of the AN/USM-708 Multi-Function Test Set, Part Number: 90-000-108, National Stock Number 4920-01-541-2764. Tel-Instrument Electronics Corp developed the subject support equipment and the Government does not own rights to this proprietary system. At this time, the Government is not pursuing the purchase of the data rights due to unsupportable timeline and cost. THIS IS NOT AN INVITATION FOR COMPETITVE PROPOSALS. This acquisition is being pursued on a sole source basis under the statutory authority of 10 USC 2304(C)(1), as implemented in FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This notice of intent is not a request for competitive proposals; however, the Government will consider all responses received to this notice. A determination by the Government not to compete this requirement is solely within the discretion of the Government. No solicitation will be available for this procurement.
