The Naval Air Warfare Center, Aircraft Division, Joint Base McGuire-Dix-Lakehurst, NJ (NAWCADLKE) intends to negotiate on a sole source basis with Keysight, Inc. for hardware and processor upgrades for four (4) FieldFox Analyzers, P/N N9910A 9 . KeySight is the Original Equipment Manufacturer and sole source for the design, development, test, manufacture, and upgrade of the FieldFox Analyzer. Keysight developed the FieldFox entirely at private expense and owns all associated data rights. Accordingly, the Government does not have sufficient engineering data to enable a competitive procurement and is not pursuing such data at this time due to unsupportable timeline and cost. The Government intends to procure the above items under the authority of 10 USC 2304 (c)(1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. A determination by the Government not to open the requirement to competition based upon the response to this notice is solely within the discretion of the Government. Responses must be received within fifteen (15) days of publication of this notice.
