Naval Air Warfare Center – Aircraft Division, Lakehurst, NJ, intends to solicit, negotiate, and award a purchase order with Bruker AXS, LLC of Fitchburg, WI, a sole source basis, for full service-level preventative maintenance, parts repair, system technical support, and minor version software updates for one QUANTAX Energy Dispersive Spectrometer (EDS) manufactured by Bruker AXS, LLC. The Bruker QUANTAX EDS is a possible radiation source. In accordance with NAWCAD radiation safety requirements, the Original Equipment Manufacturer (OEM) or its subsidiaries are the only ones able to service the instrument to ensure safe operation. Bruker AXS, LLC, as the OEM of the EDS, holds all data rights to this instrument and the controlling software. As there are no authorized servicers, Bruker AXS, LLC, is the only source able to satisfy this requirement. THIS NOTIFICATION IS NOT A REQUEST FOR PROPOSALS. No contract will be awarded on the basis of offers received in response to this notice. However, all responses received within fifteen (15) days after the date of publication of this synopsis will be considered by the Government. A determination not to compete this requirement is within the discretion of the Government.
