The Naval Air Warfare Center Aircraft Division Lakehurst, NJ, intends to negotiate a Fixed Price Indefinite Delivery Indefinite Quantity (IDIQ) contract on a non-competitive basis with Cobham Mission Systems, CAGE U11918, for Aerial Retractable Refuel Probe (ARRP)Tool Sets to include: Installation ARRP and the Tool Set (p/n: 901-266-556-101 NSN: 4920-01-518-4039), Seal Replacement ARRP (p/n: 901-266-557-101 NSN: 5330-01-508-2187). The V-22 Osprey Original Equipment Manufacturer (OEM) Bell-Boeing Joint Program Office (JPO) worked specifically with Cobham Mission Systems in the design and development of the Tool Set, Installation ARRP and the Tool Set, Seal Replacement ARRP. The tool sets were uniquely developed to meet the torque/speed limitations, specialty equipment protection, structural support. The Government does not possess the all of technical data rights that would be required to enable manufacture through an alternate source. Cobham Mission Systems and Bell-Boeing JPO are the original equipment manufacturers. While the Government assumed the rights to the Bell-Boeing JPO developed drawings, the Government did not receive rights to the Cobham Mission System drawings and Cobham Mission System still holds proprietary data rights to their drawings. This is further confirmed by the acquisition method code of `3H` for both the Tool Set, Installation ARRP and the Tool Set, Seal Replacement ARRP, which indicates: direct purchase from manufacturer, inadequate data. Both the Tool Set, Installation ARRP and the Tool Set, Seal Replacement ARRP technical data packages include information proprietary to Cobham Mission Systems. The Government intends to procure the above under the authority 10 USC 2304(C)(1), FAR 6302-1. This notice of intent is not a request for competitive proposals. However, the Government will consider all responses received within fifteen days of the posting of this notice. A determination of the Government not to opent the requirement to competition, based on the responses to this notice is soley within the discretion of the Government. Information received as a result of this notice will be considered solely for the purpose of determining whether to conduct a competitive procurement.
