The Naval Air Warfare Center, Aircraft Division, Joint Base McGuire-Dix-Lakehurst, NJ (NAWCADLKE) intends to negotiate on a sole source basis with Yanos Aerospace, Cage Code: L0997. Yanos Aerospace is the sole designer, developer, of the software and control system operating the GTE/APU Test Cells at Fleet Readiness Center East (FRCE), Cherry Point, NC 28533. The Government does not own the data rights or source code for Yanos Software suites. Since Yanos Aerospace solely owns the source code and maintains all the data rights for the various Engine Test software application Yanos is the only provider that can meet the requirements of the Government. The Government intends to procure the above items under the authority of 10 USC 2304 (c) (1), FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. A determination by the Government, not to open the requirement to competition based upon the response to this notice, is solely within the discretion of the Government.
