The Naval Air Warfare Center Aircraft Division Lakehurst, NJ (NAWCADLKE) intends to award a fixed price modification under existing contract N6833518C0162 for the design, manufacture, assembly and delivery of an additional QTY 10 Enhanced Emergency Oxygen System (EEOS) Servicing Carts on a sole source basis with The Ace Company, Inc. (CAGE CODE: 6Q895). The EEOS Program provides increased quantities of emergency oxygen to the F/A-18, EA-18G, and T-45 aircrew in the event of a physiological episode. In order to meet the high pressure oxygen requirements of the EEOS, the Enhanced Emergency Oxygen Servicing Cart was procured. Post contract award an additional 10 carts to were identified to be required by the fleet to meet the mission needs. Carts must be of the exact configuration previously procured to maintain supportability and the design is proprietary to The Ace Company, Inc. As the Original Equipment Manufacturer (OEM), The Ace Company, Inc. is the sole designer, developer and manufacturer of the Enhanced Emergency Oxygen Servicing Cart. The Ace Company, Inc. owns the technical data to all units being procured, thereby maintaining the logistical footprint and configuration management of the system's architecture. The Ace Company, Inc. is the only firm with the knowledge and expertise of the Cart. No other manufacturer would have the proprietary data, and the Government does not possess the rights to the data to determine the replacement parts and modify/develop a new drawing package accordingly. NAWCADLKE intends to award this order under the authority of 10 USC 2304 (C)(1), as implemented in FAR 6.302-1. Interested firms may identify their interest and capability to respond to the requirement. This notice of intent is not a request for competitive proposals; however, the Government will consider all responses received to this notice. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received as a result of the notice of intent will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation will be available for this procurement.
