The Naval Air Warfare Center, Aircraft Division, Lakehurst, New Jersey intends to solicit and award a five year Indefinite Delivery Indefinite Quantity contract on a sole source basis for the procurement of Differential Angle Protractor (DAP), Part Number SK2022DAP and Water Validation Test Set, P/N SK2022GMV in support of the MH-60R Domestic and Foreign Military Sales (FMS) programs. The anticipated award will be made to Habco Industries, LLC (CAGE 51826). Habco Industries, LLC, as the Original Equipment Manufacturer (OEM), qualified manufacturer, and supplier of the DAP and Water Validation Test Set, owns the proprietary rights to the engineering data and detailed product drawings for the DAP and Water Validation Test Set and does not have any distributors. The DAP and Water Validation Test Set are currently in use in the maintenance of the MH-60S and MH-60R aircraft; the part numbers to be procured under this effort will replace the legacy DAP and Water Validation Test Set, which are currently deemed not procurable as the major components needed for manufacturing are no longer in production. No other configuration will be compatible with the DAP and Water Validation Test Set currently in use, and the Government does not have the technical data or equipment to obtain these items from an alternate source. The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements" for this action. (THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS). Responsible, interested parties, however, may identify their interest by submitting a capabilities statement. The Government will consider all information received prior to the closing date of this notice. A determination by the Government not to compete this procurement based upon responses to this notice is solely within the discretion of the Government. The Government will not pay for any responses received. There are no commitments by the Government to issue any solicitations, make an award or awards, or to be responsible for any monies expended by any interested parties before award of a contract for the efforts mentioned above.
