The Naval Air Warfare Center, Aircraft Division, Lakehurst, New Jersey intends to issue a Sole Source, Fixed Price contract to Eagle Tugs, LLC, a subsidiary of Tronair, Inc. for modification of the pintle configuration on the front and rear of twenty (20) Diesel Tow Tractors, Part Number (P/N) USATS-6, NICN LL-ERG-5719, also known as tugs. The modification will be to the hitching mechanism on the front and rear of (20) USATS-6 tugs, identified by serial number, so that they are adjustable in accordance with Drawings AE-OPT-0032F and AE-OPT-0032R, rather than fixed. The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements" for this action. Eagle Tugs, LLC is the sole developer, designer, and manufacturer of the USATS-6 tug. The configuration of the USATS-6 needs to remain within the OEM’s specifications in order to meet the structural integrity of the tug and to be compatible with future configuration updates if applicable. The Government does not have the technical data or equipment to obtain this item from an alternate source. (THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS). The Government will consider all information received prior to the closing date of this notice. A determination by the Government not to compete this procurement based upon responses to this notice is solely within the discretion of the Government. The Government will not pay for any responses received. There are no commitments by the Government to issue any solicitations, make an award or awards, or to be responsible for any monies expended by any interested parties before award of a contract for the efforts mentioned above.
