The Naval Air Warfare Center, Aircraft Division, Lakehurst, New Jersey intends to issue a Sole Source, Fixed Price contract to Thales Defense and Security, Inc. (TDSI), the United States affiliate of Thales Avionics SAS (Thales) for the procurement of Cockpit Map File Loading Equipment (CMFLE) P/N: B19755AA, NSN:7035-14-584-1050 for Foreign Military Sales Czech Ministry of Defense (MOD) program. The CMFLE is support equipment (SE) for of the Optimized Top Owl (OTO) Helmet Mounted Sight and Display system installed on the AH-1Z and UH-1Y aircraft. The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements" for this action. Thales is the sole developer, designer, and manufacturer of the OTO CMFLE. The head tracking system algorithms, operating frequencies and system logic of the OTO CMFLE, which are required to interface the CMFLE with other OTO SE, are proprietary and considered protected technology by the French Government and are not available for sale. The Government does not have the technical data or equipment to obtain this SE from an alternate source. (THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS). The Government will consider all information received prior to the closing date of this notice. A determination by the Government not to compete this procurement based upon responses to this notice is solely within the discretion of the Government. The Government will not pay for any responses received. There are no commitments by the Government to issue any solicitations, make an award or awards, or to be responsible for any monies expended by any interested parties before award of a contract for the efforts mentioned above.
