The Naval Air Warfare Center - Aircraft Division Lakehurst, NJ, under the authority of 10 USC 2304(c)(1), FAR 6.302-1, intends to award a firm-fixed-price contract, on a sole-source basis, to Pregyl Services, Inc. Janesville, WI (CAGE 69K87) for the procurement of one (1) PFC 1102 HC 460 volt Polycold system in support of Fleet Readiness Center Southeast. Pregl Services, Inc. owns the copyrights to the software that was designed and programmed to be used with a PFC 1102 HC 46 volt Polycold system. Pregl Services, Inc. has no authorized service providers or distributors and is the only vendor capable of meeting the necessary requirements of FRCSE to the same form, fit and function that is compatible with the existing PFC 1102 HC 46 volt Polycold system. An adequate purchase description or other information suitable to solicit by full and open competition has not been developed because procuring future services via another source would result in a costly duplication of effort. Pregyl Services, Inc. is the only source that can provide the PFC 1102 HC 460 volt Polycold system. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, the Government will consider all responses received within fifteen days after the date of publication of this synopsis. Registration in the System for Award Management (SAM) (https://www.sam.gov) is mandatory for consideration. A determination by the Government not to open the requirement to competition based on the responses to this notice will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
