The Naval Air Warfare Center, Lakehurst, intends to enter into sole source negotiations for 12 each Flow Control Regulator Assemblies P/N 4820-0039-1, NSN 4810014932024, with an option to procure 12 each in the next option period. The Flow Control Regulator Assemblies are used to duplicate in flight mode/conditions for the Aerial Refueling Store on the MQ-25 United States Navy Triton Unmanned Aircraft System. The anticipated award will be made to Testek LLC (CAGE 06659). Testek is the only source found that has the technical knowledge and expertise necessary to manufacture the Flow Control Regulator Assemblies. Accordingly, Testek holds the proprietary rights to the diagrams, schematics, and drawings for the support equipment being acquired. The Government does not possess the required technical data. This acquisition is being pursued under the sole source basis under the statutory authority 10 USC 2304 (c)(1), as implemented in FAR 6.302-1; therefore, a solicitation is not available for this procurement. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, all responses received within fifteen days after the date of publication of this synopsis will be considered by the Government. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. Information received as a result of the notice of intent will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
