The Naval Air Warfare Center Aircraft Division Lakehurst, NJ intends to enter into sole source negotiations with Canadian Commerical Corporation (CCC) who will subcontract 100% to L3 Wescam (Cage: 3AC24) for the ongoing procurement of L3-Wescam MX series EO/IR turrets, spares, special tooling, test equipment along with repairs, modifications, and upgrades of existing L3-Wescam EO/IR equipment. The Government does not possess the data rights necessary to support a competitive procurement. L-3 possesses unique capabilities and experience necessary to successfully perform the highly specialized tasking of this requirement and is the only source capable of providing the required hardware and support. L3-Wescam has advised the Government they do not intend to sell or provide a license to the data rights associated with the MX-series turrets. Another source would need the proprietary data in order to develop the required items. The Government intends to award Firm Fixed Price delivery orders for these requirements under the authority of 10 USC 2304 (c) (1), as implemented by FAR 6.302-1. All responsible sources are encouraged to submit a proposal in writing that may be used by the Government in determining whether or not to conduct a competitive procurement. A determination by the Government not to open the requirement to competition based upon the response to this notice is solely within the discretion of the Government. Responses must be received within 15 days of publication of this notice.
