The Naval Air Warfare Center Aircraft Division Lakehurst, NJ intends to enter into sole source negotiations with L-3 Wescam through Canadian Commercial Corporation (CCC) for the procurement of one (1) WESCAM MX-15 multi-sensor, multi-spectral imaging system along with ancillary cable and maintenance kits. The Contractor shall manufacture, validate and deliver equipment as required by the Government. Acceptance shall be by Government personnel. L-3 possesses unique capabilities and experience necessary to successfully perform the highly specialized tasking of this requirement and is the only source capable of providing the required hardware and support. L3-Wescam has advised the Government they do not intend to sell or provide a license to the data rights associated with the MX-series turrets. Another source would need the proprietary data in order to develop the required items." The Government intends to award a Firm Fixed Price contract for this requirement under the authority of 10 USC 2304 (c) (1), as implemented by FAR 6.302-1. All responsible sources are encouraged to submit a proposal in writing that may be used by the Government in determining whether or not to conduct a competitive procurement. A determination by the Government not to open the requirement to competition based upon the response to this notice is solely within the discretion of the Government. The Contractor shall provide an estimated quantity of one (1) MX-15HD system. The Contractor shall manufacture, validate and deliver equipment as required by the Government.
