The Naval Air Warfare Center Aircraft Division Lakehurst, NJ intends to enter into sole source negotiations with RUAG Aerospace Services GmbH of Wessling, Germany for all necessary actions to refurbish Dornier 228 aircraft, modernize the on-board avionics suite and upgrade the existing Maritime Domain Awareness (MDA) equipment. RUAG Aerospace is the Original Equipment Manufacturer (OEM) of the Dornier 228 series aircraft. The refurbishment, modernization, and upgrade of the Dornier 228 aircraft require specific Dornier 228 airworthiness certificates as indicated in the existing STCs, which are owned by RUAG Aerospace. As the OEM, only RUAG Aerospace owns the needed Dornier 228 STCs and technical data rights needed to refurbish, modernize, and upgrade the Dornier 228 aircraft. The Government would incur a significant duplication of costs for another vendor to obtain the Dornier 228 airworthiness certificates as extensive design engineering and flight testing would be needed for another vendor to achieve the required airworthiness certificates for the Dornier 228. In addition, the Government would incur a significant delay in schedule for another vendor to obtain the needed certificates. The Government intends to award a Firm Fixed Price contract for this requirement under the authority of 10 USC 2304 (c) (1), as implemented by FAR 6.302-1. All responsible sources are encouraged to submit a proposal in writing that may be used by the Government in determining whether or not to conduct a competitive procurement. A determination by the Government not to open the requirement to competition based upon the response to this notice is solely within the discretion of the Government.
