AMENDMENT #1: The purpose of this amendment is to reopen this solictaiton and remove the Small Business set aside indicator, and, now, solicit this requirement on an unrestricted basis to promote full and open competition. This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotations are being requested and a written solicitation will not be issued. This solicitation will be open for less than 30 days, in accordance with FAR 5.203(b). Request for Quotation (RFQ) number is N6660423Q0190. The Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT) intends to award a Firm-Fixed-Price (FFP) purchase order for the following Contract Line Item (CLIN) on a Brand Name basis to an authorized reseller of Ansys, Inc. software, please see Attachment #1 Brand Name Justification. In order to be determined technically acceptable, the offeror must provide the following: (1) A quote including all of the items listed in table above. No partial quotes will be accepted. (2) Offerors must include the manufacturer name and part numbers/serial numbers of all of the items. (3) In order to be considered for award, the vendor must be an Ansys Inc authorized reseller. (4) Offerors shall certify prior to award that all Ansys Inc hardware and software to be delivered shall be licensed originally to authorized buyers. (5) Provide assertion that all items are shipped from within the US; (6) Provide assertion that all items configured in house are new products, gray market items will not be accepted; Prior to payment authorization, the Government intends to confirm with Ansys Inc that all Ansys Inc hardware/software provided under this contract has been sourced through authorized channels only and that all warranties are transferrable to the Government. Additionally, the Government will consider past performance information in accordance with DFARS Provision 252.213-7000, where negative information within SPRS may render a quote being deemed technically unacceptable. Offerors shall be advised that if after award the items delivered are determined not to be in new condition and/or are determined to be delivered from outside the US, the Government has the right to terminate for cause with the Contractor liable to the Government for any and all rights and remedies provided by the law including excess re-procurement costs. Quotations shall be e-mailed to the Primary Point of Contact, on or before the response date and time as listed on this combined synopsis/solicitation. A quote received after the closing date and time specified will not be eligible for award.
