The below is the revised criteria for determination of a Technically Acceptable Quote: This requirement will be awarded to the offeror with the lowest price technically acceptable (LPTA) quote. Technically acceptable means the items quoted match the items as detailed in the attached Requirements List (as updated in this amendment), (no substitutions allowed) in the quantities specified. In order to be determined technically acceptable: (1) the offeror must quote the items specified, in the required quantities; (2) Delivery shall be forty five days, or sooner, from date of award; (3) Offerors must provide confirmation that the shipment will be made from the US; and (4) the Government will consider past performance information in accordance with DFARS Provision 252.213-7000 where negative information within Supplier Performance Risk System (SPRS) may render a quote being deemed technically unacceptable. The following clause is added to list of applicable clauses: DFARS 252.246-7008, Sources of Electronic Parts If, after award, the delivered items do not meet all of the requirements identified above, or if the products are not shipped from within the US, the Government has the right to Terminate for Cause and the Contractor will be liable to the Government for any and all rights and remedies provided by law, including excess reprocurement costs. The Requirements List included in the original Combined Synopsis/Solicitation is replaced by the attached Requirements List dated 9/17/2019.
