N66001-21-Q-6076 – Notice of Intent to Award Sole Source to Vulnerability Research Labs This synopsis is hereby issued in accordance with FAR Part 5.201. The purpose of this synopsis is to announce the Department of the Navy, Naval Information Warfare Center (NIWC) Pacific's intent to award a commercial, Firm-Fixed-Price purchase order on a noncompetitive basis with Vulnerability Research Labs, LLC (VRL) of Columbia, MD. The requirement is for software maintenance for VRL's Ganon computer software. The maintenance includes bug fixes, vulnerabilities, customizations, OS compatibility, new features, and technical exchanges. The required maintenance will be for a 12-month base period and two, 12-month options. The Government intends to negotiate solely with VRL under the authority of FAR Part 13.5, Simplified Procedures for Certain Commercial Items. The justification is as follows. The Government is required to upkeep/update currently employed tools, which includes VRL's Ganon software, while also integrating additional toolsets into their cyberspace capabilities. Indeed, the software has become integrated into an overall suite of cyberspace weapons. However, the software is proprietary commercial computer software owned by VRL and the Government is not authorized to use or distribute VRL's software to any third party other than U.S. Government agencies outside of the maintenance arrangement contemplated in the proposed award. This software maintenance is also tied to a larger development effort that cannot move forward without updates to the toolkit. Searching for a brand new vendor will require complete rework of this portion of the larger development effort and will significantly delay and detrimentally impact current offensive cyberspace missions. Based on the approved Justification and Approval (J&A) (which will be posted after award), the agency has identified only one responsible source and no other supplier will satisfy agency requirements. The applicable NAICS Code is 511210 "Software Publishers" and the business size standard is $41,500,000.00. Please be advised that the aforementioned information is anticipatory in nature and is not binding. This notice is not a request for competitive quotes; however, interested parties may identify their interest and capabilities in response to this synopsis. All responses received before this date will be considered by the Government for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete based upon responses to this notice is solely within the discretion of the Government.
