The government will not recognize cost associated with submission of any information submitted. The Naval Medical Logistics Command intends to negotiate on a sole source basis (IAW FAR 13.1) with Microgenics Corporation., 46500 Kato Road, Fremont CA 94538-3342, as the only source that can provide immunoassay reagent kits for the detection of detecting THC-COOH in human urine samples. NMLC is in the process of awarding a longer-term competitive procurement immunoassay reagent kits for the detection of detecting THC-COOH, in human urine samples, under solicitation N6264520R0038. It was posted on 20 August 2020 with a closing date of 19 September 2020, but due to corrective action taken in response to a GAO protest the solicitation was cancelled and is being re-solicited. Due to unexpected delays and unforeseen circumstances a new IDIQ cannot be awarded by before 11 December 2020. Microgenics Corporation is the only vendor to go through and pass DDRP required reagent testing for THC-COOH. The DDPR labs cannot operate with reagents that have not been tested and/or calibrated with their equipment which is a time consuming process handled via a competitive acquisition. Microgenics is the only vendor that can provide DDPR with a valid reagents until long term contract can be awarded through a competitive process. This acquisition is being conducted under simplified procedures for certain Commercial Items FAR 13.1. There are not set-aside restrictions for this requirement. The intended procurement will be classified under North America industry Classification System (NAICS) 325413 with a Small Business Size Standard of 1250. This notice of intent is not a request for competitive proposals and no solicitation document exists for this requirement. However, parties interested in responding to this notice will need to submit technical data, including cost, sufficient to determine capability in providing the same product. All capability statements received by the closing date of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
