Identification of the agency and the contracting activity, and specific identification of the document as a “Brand Name Justification.” This is a brand name justification. Contracting activity is Naval Sea Systems Command Naval Surface Warfare Center Panama City Division (NSWC PCD) 110 Vernon Avenue, Panama City, FL 32407-7001 Contracts Department Code 02 2. Nature and/or description of the action being approved. This action will award a firm fixed price order to the most highly qualified authorized reseller of SDV MK 8 Din Valves. 3. A description of the supplies or services required to meet the agency’s needs (including the estimated value). The purchase is to acquire the following: SDV MK 8 Din Valves, as described below. Line No. 1 Part Number 7110360-2 Description VALVE, DIN IAW all requirements and notes of DWG 7110360 – includes all required documentation per the drawing Quantity 100 EA Line No. 2 Part Number COC Description Certificate of Compliance Quantity 100 EA The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. All items will be delivered no later than 14 weeks upon receipt of order. (Redacted) 4. NSWC PCD Code S11 currently has a need for SDV MK 8 Din Valves, as referenced in Section 2 of this document. Aqua Lung is the OEM and the only manufacturer of the items listed in Section 2 per the approved engineering drawing (Note 4 of NAVSEA drawing 7110360, Rev. E). The Aqua Lung Din Valves are compatible with the existing system, and there are currently no other approved manufacturers for them. Alternate items are not compatible with the existing system; therefore, it is advantageous to the Government to acquire the items listed in Section 2, with no substitutes. 5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, recurring cost, special features, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs. 6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. The purchase amount is greater than $25,000 and will be synopsized on the Contract Opportunities website at sam.gov. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Aqua Lung to provide the products. 7. Any other facts supporting the justification. None. 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. As stated in paragraph 4 above, Aqua Lung is the only brand that can meet this requirement.
