This action will award a firm fixed price order to the following on a sole source basis: Vicon Motion Systems, Inc. 7388 South Revere Parkway, Suite 901 Centennial, CO 80112-3997 Cage: 1P2E1 Procurement is for IMU Blue Trident Sensors. A description of the supplies or services required to meet the agency’s needs (including the estimated value). This requirement is to purchase the following: Manufacturer # Description Quantity IMU Trident V2.1 IMU Blue Trident Sensor – Medium Strap 44 EA The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. The sensors will be delivered no later than forty (40) days after award of the order. --Redacted-- Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1: The Naval Surface Warfare Center Panama City Division (NSWC PCD) Code E40, Human Systems Integration Team currently has Office of Naval Research FY22 tasking to conduct a quantitative biomechanical assessment of the Naval Special Warfare high speed crafter operators cumulative exposure to repeated mechanical shocks and transient vibration, and to assess the efficacy of shock mitigating technologies in protecting them from brain and spine injuries. To do so, each of four operators must have at least ten sensors mounted at key injury sites including legs, hips, lumbar, cervical, collarbone, and head. The human worn sensors must be light-weight (<10g) so as to not incur additional burden on the boat operators, self-contained, so as not to tether the operators to the craft, waterproof (enabling rough water testing in an open craft), rugged, and with a battery life of at least 10 hours. To allow oversampling for purposes on anti- aliasing the data, while collecting usable data within the range of human response, the sensors must sample at 1,000 Hz or greater. For the high speed craft targeted in this study, the sensors must provide three axes (x-, y-, & z-) and angular rate data sensitive to both the low-G range (<20g) and high-G ( up to 200g). So far, the IMU Blue Trident Sensors are the only commercially available sensors determined to meet all of these criteria. This purchase is not suitable for full and open competition for the following reasons: IMU Blue Trident Sensors are proprietary to Vicon; therefore, they retain full rights and ownership of the sensor design. Designed for human use, the IMU Blue Trident Sensors are the only commercially available sensors meeting the data collection parameters (particularly sample rate), form, fit, and weight requirements needed specifically for biomechanical, impact injury data collection. They are the only sensors sufficiently marinized for open craft testing in high sea states. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. This requirement will be synopsized on the Contract Opportunities website at sam.gov per FAR Part 5.2. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Vicon Motion Systems, Inc. to provide the products. Deliveries will not be accepted on Saturdays, Sundays or Holidays except as specifically requested by the [insert activity name]. All goods or services attempted to be delivered on a Saturday, Sunday or Holiday without specific instructions from the Contracting Officer or his duly appointed representative will be returned to the contractor at the contractor’s expense with no cost or liability to the U.S. Government. The federal Government observes public Holidays that have been established under 5 U.S.C. 6103. Delayed Opening, Early Dismissal and Closure of Government Facilities. When a Government facility has a delayed opening, is closed or Federal employees are dismissed early (due to severe weather, security threat, security exercise, or a facility related problem) that prevents personnel from working, onsite contractor personnel regularly assigned to work at that facility shall follow the same reporting and/or departure directions given to Government personnel. The contractor shall not direct charge to the contract for such time off, but shall follow parent company policies regarding taking leave (administrative or other). Non-essential contractor personnel, who are not required to remain at or report to the facility, shall follow their parent company policy regarding whether they should go/stay home or report to another company facility. Subsequent to an early dismissal, delayed opening, or during periods of inclement weather, onsite contractors should monitor the OPM website as well as radio and television announcements before departing for work to determine if the facility is closed or operating on a delayed arrival basis. When Federal employees are excused from work due to a holiday or a special event (that is unrelated to severe weather, a security threat, or a facility related problem), on site contractors shall continue working established work hours or take leave in accordance with parent company policy. Those contractor employees who take leave shall not direct charge the non-working hours to the contract. These official files may contain information that is considered a trade secret, proprietary, business sensitive or otherwise protected pursuant to law or regulation, hereinafter referred to as “protected information”. File management services consist of any of the following: secretarial or clerical support; data entry; document reproduction, scanning, imaging, or destruction; operation, management, or maintenance of paper-based or electronic mail rooms, file rooms, or libraries; and supervision in connection with functions listed herein. (b) The cognizant Contracting Officer will ensure that any NAVSEA contract under which these file management services are acquired will contain a requirement that (1) The support contractor not disclose any information; (2) Individual employees are to be instructed by the support contractor regarding the sensitivity of the official contract files; (3) The support contractor performing these services be barred from providing any other supplies and/or services, or competing to do so, to NAVSEA for the period of performance of its contract and for an additional three years thereafter unless otherwise provided by law or regulation; and, (4) In addition to any other rights the offeror may have, it is a third party beneficiary who has the right of direct action against the support contractor, or any person to whom the support contractor has released or disclosed Protected Information, for the unauthorized duplication, release, or disclosure of such Protected Information.
