Identification of the agency and the contracting activity, and specific identification of the document as a Limited Source Justification.” This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02). 2. Nature and/or description of the action being approved. Authorization to upgrade commercially available parts for the Landing Craft Air Cushion (LCAC), Command, Control, Communications, Computers, and Navigation (C4N) Systems project NAG Marine 2511 Walmer Avenue, Suite B, Norfolk, VA 23513 (CAGE Code 1PL37) on the basis of other than full and open competition. 3. A description of the supplies or services required to meet the agency s needs (including the estimated value). The contract effort is to acquire: Base Quantity (Currently funded) DESCRIPTION PART NUMBER QUANTITY Assy; MILPONS; KVN Computer 1001RS0A01 A 11 The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000. All equipment will be delivered no later than sixteen (16) weeks after award of the order. The contract action will be funded with FY 2022 Operation and Maintenance Navy (O&MN) funds. 4. Identification of the justification rationale (see FAR 8.405-6(a) and (b)) and, if applicable, a demonstration of the proposed contracto s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1) - 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements. NSWC PCD is the design authority for the LCAC C4N systems. These systems are part of the Service Life Extension Program (SLEP). The Amphibious Warfare Program Office PMS317 J- Division SLEP program of record is in the process of upgrading legacy craft. This action is to upgrade eleven (11) Windows 7 version Keypad, Video, and Navigation (KVN) Computers, P/N 100RS0001 to Windows 10 version P/N: 1001RS0A01 A. This upgrade includes replacement of the Network Interface Controller (NIC) and increasing the memory from 8GB to 16GB. NSWC PCD Command, Control, Communications, Computers, Navigation (C4N) program will provide the eleven(11) KVN's, P/N 100RS0001 as Government Furnished Material (GFM) to be upgraded. The computers are commercial items manufactured by NAG Marine. This action is not suitable for full and open competition and it is in the best interest of the Government to upgrade these units non- competitively because NAG Marine is the only company that makes this slightly modified commercial item that is compliant with the Government owned SBC4 Technical Data Package (TDP). Developing another source to upgrade these units would be cost and schedule prohibitive. The total estimated cost to develop, test and evaluate a different product to satisfy this requirement is estimated at $1.5 million dollars, and the lead time associated with the development, test and evaluation of this requirement is estimated at 18 months. 5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, reoccurring cost, administrative costs, engineering and redesign costs, etc.) to meet the Government’s needs. 6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. This requirement will be synopsized via posting on the Commercial Opportunities website at SAM.gov per FAR 5.2. No additional market research was conducted for the reasons specified in paragraph 4 above. 7. Any other facts supporting the justification: None. 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. Supporting documentation in Wide Area Workflow (WAWF) for invoices shall include summaries of work charged during the period covered as well as overall cumulative summaries by individual labor categories, rates, and hours (both straight time and overtime) invoiced; as well as, a cost breakdown of other direct costs (ODCs), materials, and travel, by technical instruction (TI), SLIN, or CLIN level. Should the subcontractor lack encryption capability, the subcontractor may also email detailed supporting cost information directly to the Contracting Officer and COR; or other method as agreed to by the Contracting Officer. (b) Contractors submitting payment requests and receiving reports to WAWF using either Electronic Data Interchange (EDI) or Secure File Transfer Protocol (SFTP) shall separately send an email notification to the COR and Contracting Officer on the same date they submit the invoice in WAWF. No payments shall be due if the contractor does not provide the COR and Contracting Officer email notification as required herein. Deliveries will not be accepted on Saturdays, Sundays or Holidays except as specifically requested by the [insert activity name]. All goods or services attempted to be delivered on a Saturday, Sunday or Holiday without specific instructions from the Contracting Officer or his duly appointed representative will be returned to the contractor at the contractor’s expense with no cost or liability to the U.S. Government. The federal Government observes public Holidays that have been established under 5 U.S.C. 6103. Delayed Opening, Early Dismissal and Closure of Government Facilities. When a Government facility has a delayed opening, is closed or Federal employees are dismissed early (due to severe weather, security threat, security exercise, or a facility related problem) that prevents personnel from working, onsite contractor personnel regularly assigned to work at that facility shall follow the same reporting and/or departure directions given to Government personnel. The contractor shall not direct charge to the contract for such time off, but shall follow parent company policies regarding taking leave (administrative or other). Non-essential contractor personnel, who are not required to remain at or report to the facility, shall follow their parent company policy regarding whether they should go/stay home or report to another company facility. Subsequent to an early dismissal, delayed opening, or during periods of inclement weather, onsite contractors should monitor the OPM website as well as radio and television announcements before departing for work to determine if the facility is closed or operating on a delayed arrival basis. When Federal employees are excused from work due to a holiday or a special event (that is unrelated to severe weather, a security threat, or a facility related problem), on site contractors shall continue working established work hours or take leave in accordance with parent company policy. Those contractor employees who take leave shall not direct charge the non-working hours to the contract. Contractors are responsible for predetermining and disclosing their charging practices for early dismissal, delayed openings, or closings in accordance with the FAR, applicable cost accounting standards, and the company’s established policy and procedures. Contractors shall follow their disclosed charging practices during the contract period of performance, and shall not follow any verbal directions to the contrary. These official files may contain information that is considered a trade secret, proprietary, business sensitive or otherwise protected pursuant to law or regulation, hereinafter referred to as “protected information”. File management services consist of any of the following: secretarial or clerical support; data entry; document reproduction, scanning, imaging, or destruction; operation, management, or maintenance of paper-based or electronic mail rooms, file rooms, or libraries; and supervision in connection with functions listed herein. (b) The cognizant Contracting Officer will ensure that any NAVSEA contract under which these file management services are acquired will contain a requirement that (1) The support contractor not disclose any information; (2) Individual employees are to be instructed by the support contractor regarding the sensitivity of the official contract files; (3) The support contractor performing these services be barred from providing any other supplies and/or services, or competing to do so, to NAVSEA for the period of performance of its contract and for an additional three years thereafter unless otherwise provided by law or regulation; and, (4) In addition to any other rights the offeror may have, it is a third party beneficiary who has the right of direct action against the support contractor, or any person to whom the support contractor has released or disclosed Protected Information, for the unauthorized duplication, release, or disclosure of such Protected Information. (c) Submission of a proposal will be considered as consent to NAVSEA's permitting access to any information, irrespective of restrictive markings or the nature of the information submitted, by its file management support contractor for the limited purpose of executing its file support contract responsibilities. (d) NAVSEA may, without further notice, enter into contracts with other contractors for these services.
