Subj: SOLE SOURCE TO ACQUIRE KAESER SK20 AIR COMPRESSOR AND INSTALLLATION SUPPORT 1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.” This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001. 2. Nature and/or description of the action being approved. This action will award a firm fixed price contract on a sole source basis, to provide and install a Kaeser SK20 air compressor, Kaeser Cycling Refrigerated Air Dryer TC-31, and 240 gallon air receiver tank in the mechanical room of NEDU with Air Power Services, Pensacola, FL. 3. A description of the supplies or services required to meet the agency’s needs. The following equipment and services are being acquired: 1) Kaeser SK20 Air Compressor Kaeser Cycling Refrigerated Air Dryer: Model TC-31 Air Receiver 2) PVC, Piping and Installation The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. All equipment will be installed no later than ninety (90) days after award of purchase order. 4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302- 1(a)(2)(iii)(B). This procurement is sole source for the following reasons. Kaeser air compressors are utilized through the Navy Experimental Diving Unit facility. Due to technical specifications and continuity of maintenance schedules, spare part procurements, petroleum/oils/lubricants (POLs), hazardous materials procurement (HAZMAT) and hazardous waste (HAZWASTE) concerns, the Kaeser SK20 compressor, TC-31 dryer, and 240 gallon receiver tanks are required. Additionally, the required procurements and maintenance can only be performed by Air Power Systems as they are the sole distributer and sole qualified entity for maintenance on Kaeser compressor systems in the southeast United States. Therefore, only Air Power Systems is capable to fulfill the requirements of the Command. 5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b). The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs. 6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. No other venders were found to fulfill the procurement availability and critical certification requirements that Air Power Systems can provide. 7. Any other facts supporting the justification. Due to Air Power Systems being the sole maintenance provider for these compressor systems, they are currently under contract to perform all maintenance on the compressor systems at the Command. 8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. As stated in paragraph 4 and 7 above, Air Power Systems is the only company that can sell and perform the installation and maintenance/repairs on Kaeser air compressor systems.
