Description: Naval Facilities Engineering Systems Command (NAVFAC), Northwest is soliciting comments from the public addressing the potential use of Project Labor Agreements (PLA) for the following construction project. The construction project is for Building and/or Heavy (non-building/residential) requirements in support of P859 CVN 78 Aircraft Carrier Electrical Upgrades, Naval Base Kitsap (NBK) Bremerton, Puget Sound Naval Shipyard (PSNS), located in the State of Washington. The designated Defense Priorities and Allocation System (DPAS) priority rating for this project is DX-C2. Construction may include, but is not limited to: demolition of an existing substation and the construction of a new substation at a different locations; construction of a new substation building made of concrete and steel that houses indoor switchgear, battery banks, an office, restroom facilities, fire protection, and HVAC; electrical, civil, and structural work required to upgrade power connections to accommodate simultaneous mooring; Antiterrorism (AT) features; pile wall reinforcement and transformer fire separation wall; foundations made of concrete for exterior electrical equipment and secondary containment systems, such as transformers, circuit breakers, and disconnect switches; electrical duct banks made of concrete-encased polyvinyl chloride (PVC) conduits that connect the new substation to the existing kilovolt (kV) transmission line and the shipyard distribution system; site preparation including site clearing, excavation and grading, and removal and disposal of hazardous material and contaminated soil; pavement resurfacing and site improvements; electrical utilities; mechanical utilities including storm water, sanitary sewer, water distribution and compressed air distribution to supply the substation buildings. A PLA is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement as described in 29 U.S.C. 158 (f). Federal Acquisition Regulation (FAR) policy states: Executive Order (E.O.) 14063, Use of Project Labor Agreements for Federal Construction Projects, requires agencies to use PLAs in large-scale construction projects (defined as a construction projects with a total estimated cost at or above $35M) to promote economy and efficiency in the administration and completion of Federal construction projects. When awarding a contract in connection with a large-scale construction project, agencies shall require use of a PLA for contractors and subcontractors engaged in construction on the project, unless an exception(s) at FAR 22.504(d) applies.
