Nature and/or description of the action. The award of a contract to the GSA Advantage contractor: Leica Microsystems, Inc is requested for the purchase of a Cryostat. The unit required is a Leica CM 1860 UV configuration Cryostat. Leica Microsystems, Inc 14008 Collections Center Drive Chicago, IL 60693 3. Description of Supplies or Services: NAMRU Dayton presently has need of a Cryostat. Our in-house cryostat is no longer functioning so we are presently at a work stoppage. This fiscal year we have several projects presently under way that will require histopathological tissues slicing to characterize the effects of test materials on harvested materials. This particular model has been identified as being capable of performing all the essential tasks needed for NAMRU Dayton to complete our mission. The instrument is a professional model cryostat used in clinical applications. It can be disinfected by UV as that system is installed in this model. The surfaces are coated with AgProtect TM silver. It also includes a stepper motor and has a well-organized work space. The GSA price for the model is $28107.24 which is considered fair and reasonable since the typical retail for this model is around $31K. 4. Identification of the statutory exceptions permitting other than full and open competition. The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and FAR 6.302-1 sole source (including brand name) acquisitions OR FAR 13.106-1(b)(1) soliciting from a single source. 10 U.S.C. 2304(c)(2), Unusual and compelling urgency. FAR 6.302-2, Unusual and Compelling 5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. As stated earlier, we are presently at a work stoppage. We have identified a unit on GSA advantage that is in our professional opinion the best suited for our needs and is considered a unit that had there not been compelling urgency, we would have considered for full and open competition. To delay this purchase will put us at risk of losing data. The tissues we harvest are time sensitive and since the project is presently running, we are at risk of compromise to our statistical evaluation if we lose data points. Loss of data will endanger the integrity of our organization in the eyes of our sponsor and future sponsors causing the Government to potentially lose award/grants for future research. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable. Government agencies are encouraged to utilize Government sources for their acquisitions. NAMRU Dayton has made every effort to comply with that request. Our requested device is quoted from the GSA Advantage website. 7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the Leica Microbiosystems, Inc commercial price list and will be determined fair and reasonable. The GSA price for the model desired is $28107.24 which is considered fair and reasonable since the typical retail for this model is around $31K. 8. NAMRU Dayton staff is comprised of professionals who actively try to maintain expertise in their field. Reading journal articles; research materials and methods is something they do on a regular basis. In their endeavors, they frequently research what types of equipment are currently state of the art for their research. Vendors at tradeshows are consulted, in addition to posing questions to vendors via their websites to ascertain what equipment will best suit our needs. Market Research is ongoing with our staff; it is considered part of every project. 9. Other facts supporting the use of other than full and open competition. N/A 10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition. Leica Microbiosystems, inc provided a quote which is what was used to compare the GSA Advantage website price against. 11.Statement of actions, if any, the agency may take to remove or overcome any barriersto competition before any subsequent acquisition for the supplies or services required.For the reasons set forth in Paragraph 5, NAMRU Dayton has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAMRU-D will assess whether competition for future requirements is feasible. This is a one-time purchase. It was precipitated by the breakdown of an in-house piece of equipment used for critical data collection.
