This notice serves as Portsmouth Naval Shipyard's (PNS) intent to Sole Source to IB CONTROLS (cage 396M4). The Contractor shall provide all labor, tools, equipment, supervision, and transportation necessary to provide complete troubleshooting, maintenance, and repair services as required for the control systems located on the Dry Dock #1 Refueling Complex (DD#1 Complex) and Dry Dock #2 Equipment Storage Enclosure (ESE-1) at Portsmouth Naval Shipyard (PNS). The work includes troubleshooting, support services, equipment repairs/replacement, software programming, and administration with a Period of Performance of 2023-08-04 to 2024-08-03. Under the authority of 10 USC 2304 (c) and FAR 13.106-1(b)(1)(i), only one responsible source and no other supplies or services will satisfy the agency requirements. The installing contractor (IB CONTROLS) maintains proprietary ownership of the system’s programming code. The code is inherent to the operation of the control system and for another contractor to work on this system, the operating program (i.e., the code) would need to be swapped for that of the incoming service contractor. This is impractical as it would essentially be replacing the system with a new system which would require extensive testing over the course of several months to a year. The control system is mainly comprised of “Delta” electronics/programming. IB CONTROLS is the only technical representative for Delta products in the Kittery, ME area. The control system placed into service at DD #1 is very complex. Any other contractor than IB CONTROLS would require an extensive amount of time to familiarize themselves with the product before they could be trusted to make any changes. Additionally, any changes made by a different contractor would come with a significant likelihood of creating additional problems resulting in delays for rework, testing, and the likelihood of even more problems being generated.
