The Government intends to purchase on a firm fixed-price basis and to solicit the proposed purchase order on a Sole Source basis with STRATASYS, INC. for the purchase of Emerald Care 450 under the authority of FAR Part 12, FAR Part 13. Stratasys, Inc. is the OEM and as such owns the rights to all the related intellectual property related to the function and maintenance of the equipment. The source is also the sole developer of the required software. Offerors must be registered in the System for Award Management (SAM) database prior to submission of an offer to be considered for award of any DoD contract. A determination by the Government not to compete this proposed contract based upon the responses to this notice is solely within the discretion of the government.
