The Naval Air Systems Command (NAVAIR), Naval Air Station (NAS) Patuxent River, MD, intends to negotiate and award, on a sole source basis, a contract to Survival Innovation, LLC for modifications to the HBU-30/P Advanced Crew Tether System (ACTS) to address critical safety issues related to the emergency tether release assembly, fit and donning issues, the procurement of technical data, and procurements of upgraded ACTS and tethers. The proposed contract actions for the procurement are those for which the Government intends to negotiate with only one source under the authority of 10 U.S.C.3204(a)(1) and FAR 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.” Survival Innovation, LLC is the Original Equipment Manufacturer (OEM) for the current ACTS. As the sole designer, developer, manufacturer, and supplier of ACTS, only Survival Innovation, LLC has the requisite knowledge, technical expertise, required technical data, production tooling, facilities, and experience necessary to support engineering, logistics, testing, and manufacturing, associated with the ACTS. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. Interested parties, however, may identify their interest and capability by responding to the requirement with a capability statement. The Government will consider all information received prior to the closing date of this synopsis. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete the proposed contract modification based upon responses to this notice is solely within the discretion of the Government.
