The contractor must comply with clauses covering safeguarding sensitive conventional arms, ammunition, and explosives; Buy American/free trade agreements/balance of payments; limitations on pass-through charges; security prohibitions and exclusions; and a national defense, emergency preparedness, and energy priority rating. Evaluation is for commercial products and services, with a deviation allowing only one offer. The contract, delivery order, purchase order, or modification is issued when deposited in the mail, faxed, or sent electronically, and the Government’s acceptance of the contractor’s proposal constitutes bilateral agreement to issue it.

The requirement is for 44 units of NSN 7R-5895-011629391-GL, in accordance with reference 647-3487-002, with delivery FOB Origin. This flight-critical part requires engineering source approval by the design control activity, and only previously approved sources have been solicited; the Government intends to solicit and negotiate with one source under FAR 6.302-1. Approved sources retain essential data rights, manufacturing/repair knowledge, or technical data not economically available to the Government, so an alternate source must qualify under the design control activity’s procedures approved by the cognizant Government engineering activity. Non-approved sources must submit the source approval information specified in the applicable NAVSUP WSS Source Approval Information Brochure, and incomplete submissions will not be considered for award. Because source approval may not be completed in time, award may proceed based on Fleet support needs; responsible sources may still submit proposals, quotations, or capability statements for consideration.
