This Sources Sought notice is being posted to satisfy the requirement of Defense Federal Acquisition Regulation Supplement 206.302-1(d). The Naval Surface Warfare Center, Indian Head Division (NSWC IHD), Contracts Department, Code 02 intends to award a contract for the purchase of several Skyraider R80D Aircraft Kits on a sole source basis with FLIR Detection, Inc. (CAGE 1YFE1), 7055 Troy Hill Drive, Elkridge, MD 21043. FLIR Detection, Inc. is the manufacturer of the only multirotor Unmanned Ariel Vehicle (UAV) not considered a Commercial Off The Shelf (COTS) system and are in compliance with NDAA 202 848 statutory requirements, capable of carrying a payload of up7.7lbs, and meets the following criteria: Any UAS that is run as a formal Program of Record under a Service-Level Program Offfice, or Any UAS that : Has a Cyber-vulnerability assessment (i.e. completed the Risk Management Framework Process Defined in DoDi 8510.01) by any Service or Component and Has an Authority to Operate (ATO) by any Service Component, and Both the cyber-vulnerability assessment and the ATO are managed by an appropriate Service-Level Authorizing Official. Or is system identified as a NON-COTS based on the following CTOS definition (a) All UAS systems that are sold in substantial quantity in the marketplace and are offered to the Government in the same form in which it is sold to non-government consumers. The UAS systems are commercially available to the public including domestic and foreign manufacturers. (b) All UAS that in original form were commercially available, but have been modified with different hardware, software, or payloads. (c) All UAS ground command and control elements to include smart phone or tablet with associated software and hardware. As such, the following systems are considered as, "not sold in substantial quantity in the marketplace" and therefore are not considered COTS, or are considered Programs of Record (POR) with an approved Authority to Operate (ATO) and cyber-vulnerability assessment. THIS IS NOT AN INVITATION FOR COMPETITIVE PROPOSALS. This acquisition is being pursued on a sole source basis under the statutory authority of 10 USC 2304(C)(1), as implemented in FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This notice of intent is not a request for competitive proposals; however, the Government will consider all responses received to this notice. A determination by the Government not to compete this requirement is solely within the discretion of the Government. No solicitation will be available for this procurement. Information provided herein is subject to change and in no way binds the Government to solicit or award a contract.
