The Naval Surface Warfare Center, Indian Head Division (NSWC IHD), Contracts Department, Code 02 intends to increase the ceiling on a previously awarded Basic Ordering Agreement (BOA) N00174-23-G-0001. The BOA is to support the MK 38 Machine Gun Systems (MGS) including Open, Inspect and Repair efforts, Engineering Services, Linux Operating System Upgrades, Mod2 to Mod3 Conversion Kits and associated hardware, and spares on a sole source basis with BAE Systems, Minneapolis, Minnesota. BAE is the supplier of the MK 38 and has the facility to assemble, repair and overhaul the gun mount and subassemblies. BAE Systems is the only source that can provide the gun system components and services required to the U. S. Government because of their teaming agreement with Rafael Advanced Defense Systems, Ltd., the original manufacturer of the MK 38. THIS IS NOT AN INVITATION FOR COMPETITIVE PROPOSALS. This acquisition is being pursued on a sole source basis under the statutory authority of 10 USC 2304(C)(1), as implemented in FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This notice of intent is not a request for competitive proposals; however, the Government will consider all responses received to this notice. A determination by the Government not to compete this requirement is solely within the discretion of the Government. No solicitation will be available for this procurement. This Solicitation will be restricted under 10 U.S.C. SS 3204 (a) (1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2); Only one responsible source and no other supplies or services will satisfy agency requirements. BAE Systems is the original designer, developer, and the only manufacturer of the MK38 MGS, which has already been tested and installed aboard various U.S. Navy and Coast Guard platforms.
