This Sources Sought notice is being posted to satisfy the requirement of Defense Federal Acquisition Regulation Supplement 206.302-1(d). The Naval Surface Warfare Center, Indian Head Explosive Ordnance Disposal Technology Division (NSWC IHEODTD), Contracts Department, Code 02 intends to award a contract for the purchase of several Mk 38 Mod 3’s on a sole source basis with BAE Systems Land & Armaments, Inc. (CAGE 475F8), 2941 Fairview Park Dr. Ste 100 Falls Church, VA 22042. BAE Systems Land & Armaments, Inc. is the only qualified vendor capable of providing the Mk 38 Mod 3’s as BAE is the original designer, developer, and the only manufacturer of the MK38 MGS, which has already been tested and installed aboard various U.S. Navy and Coast Guard platforms. THIS IS NOT AN INVITATION FOR COMPETITIVE PROPOSALS. This acquisition is being pursued on a sole source basis under the statutory authority of 10 USC 2304(C)(1), as implemented in FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This notice of intent is not a request for competitive proposals; however, the Government will consider all responses received to this notice. A determination by the Government not to compete this requirement is solely within the discretion of the Government. No solicitation will be available for this procurement. Information provided herein is subject to change and in no way binds the Government to solicit or award a contract. All interested sources shall provide the organization name, address, point of contact, phone number, fax number, e-mail address, business size, taxpayer identification number, DUNS number, and CAGE Code. In addition, all interested sources shall provide a summary of their company’s capabilities.
