As prescribed in 223.370-5, use the following clause: SAFETY PRECAUTIONS FOR AMMUNITION AND EXPLOSIVES (MAY 1994) (a) Definition. “Ammunition and explosives,” as used in this clause— (1) Means liquid and solid propellants and explosives, pyrotechnics, incendiaries and smokes in the following forms: (i) Bulk, (ii) Ammunition; (iii) Rockets; (iv) Missiles; (v) Warheads; (vi) Devices; and (vii) Components of (i) through (vi), except for wholly inert items. (2) This definition does not include the following, unless the Contractor is using or incorporating these materials for initiation, propulsion, or detonation as an integral or component part of an explosive, an ammunition or explosive end item, or of a weapon system— (i) Inert components containing no explosives, propellants, or pyrotechnics; (ii) Flammable liquids; (iii) Acids; (iv) Oxidizers; (v) Powdered metals; or (vi) Other materials having fire or explosive characteristics. (b) Safety requirements. (1) The Contractor shall comply with the requirements of the DoD Contractors' Safety Manual for Ammunition and Explosives, DoD 4145.26-M, hereafter referred to as “the manual,” in effect on the date of the solicitation for this contract. The Contractor shall also comply with any other additional requirements included in the schedule of this contract. (2) The Contractor shall allow the Government access to the Contractor's facilities, personnel, and safety program documentation. The Contractor shall allow authorized Government representatives to evaluate safety programs, implementation, and facilities. (c) Noncompliance with the manual. (1) If the Contracting Officer notifies the Contractor of any noncompliance with the manual or schedule provisions, the Contractor shall take immediate steps to correct the noncompliance. The Contractor is not entitled to reimbursement of costs incurred to correct noncompliances unless such reimbursement is specified elsewhere in the contract. (2) The Contractor has 30 days from the date of notification by the Contracting Officer to correct the noncompliance and inform the Contracting Officer of the actions taken. The Contracting Officer may direct a different time period for the correction of noncompliances. (3) If the Contractor refuses or fails to correct noncompliances within the time period specified by the Contracting Officer, the Government has the right to direct the Contractor to cease performance on all or part of this contract. The Contractor shall not resume performance until the Contracting Officer is satisfied that the corrective action was effective and the Contracting Officer so informs the Contractor. (4) The Contracting Officer may remove Government personnel at any time the Contractor is in noncompliance with any safety requirement of this clause. (5) If the direction to cease work or the removal of Government personnel results in increased costs to the Contractor, the Contractor shall not be entitled to an adjustment in the contract price or a change in the delivery or performance schedule unless the Contracting Officer later determines that the Contractor had in fact complied with the manual or schedule provisions. If the Contractor is entitled to an equitable adjustment, it shall be made in accordance with the Changes clause of this contract. (d) Mishaps. If a mishap involving ammunition or explosives occurs, the Contractor shall— (1) Notify the Contracting Officer immediately; (2) Conduct an investigation in accordance with other provisions of this contract or as required by the Contracting Officer; and (3) Submit a written report to the Contracting Officer. (e) Contractor responsibility for safety. (1) Nothing in this clause, nor any Government action or failure to act in surveillance of this contract, shall relieve the Contractor of its responsibility for the safety of— (i) The Contractor's personnel and property; (ii) The Government's personnel and property; or (iii) The general public. (2) Nothing in this clause shall relieve the Contractor of its responsibility for complying with applicable Federal, State, and local laws, ordinances, codes, and regulations (including those requiring the obtaining of licenses and permits) in connection with the performance of this contract. (f) Contractor responsibility for contract performance. (1) Neither the number or frequency of inspections performed by the Government, nor the degree of surveillance exercised by the Government, relieve the Contractor of its responsibility for contract performance. (2) If the Government acts or fails to act in surveillance or enforcement of the safety requirements of this contract, this does not impose or add to any liability of the Government. (g) Subcontractors. (1) The Contractor shall insert this clause, including this paragraph (g), in every subcontract that involves ammunition or explosives. (i) The clause shall include a provision allowing authorized Government safety representatives to evaluate subcontractor safety programs, implementation, and facilities as the Government determines necessary. (ii) NOTE: The Government Contracting Officer or authorized representative shall notify the prime Contractor of all findings concerning subcontractor safety and compliance with the manual. The Contracting Officer or authorized representative may furnish copies to the subcontractor. The Contractor in turn shall communicate directly with the subcontractor, substituting its name for references to “the Government”. The Contractor and higher tier subcontractors shall also include provisions to allow direction to cease performance of the subcontract if a serious uncorrected or recurring safety deficiency potentially causes an imminent hazard to DoD personnel, property, or contract performance. (2) The Contractor agrees to ensure that the subcontractor complies with all contract safety requirements. The Contractor will determine the best method for verifying the adequacy of the subcontractor's compliance. (3) The Contractor shall ensure that the subcontractor understands and agrees to the Government's right to access to the subcontractor's facilities, personnel, and safety program documentation to perform safety surveys. The Government performs these safety surveys of subcontractor facilities solely to prevent the occurrence of any mishap which would endanger the safety of DoD personnel or otherwise adversely impact upon the Government's contractual interests. (4) The Contractor shall notify the Contracting Officer or authorized representative before issuing any subcontract when it involves ammunition or explosives. If the proposed subcontract represents a change in the place of performance, the Contractor shall request approval for such change in accordance with the clause of this contract entitled “Change in Place of Performance-Ammunition and Explosives”. (End of clause) 252.223-7003 Change in Place of Performance--Ammunition and Explosives. As prescribed in 223.370-5, use the following clause: CHANGE IN PLACE OF PERFORMANCE--AMMUNITION AND EXPLOSIVES (DEC 1991) (a) The Offeror shall identify, in the “Place of Performance” provision of this solicitation, the place of performance of all ammunition and explosives work covered by the Safety Precautions for Ammunition and Explosives clause of this solicitation. Failure to furnish this information with the offer may result in rejection of the offer. (b) The Offeror agrees not to change the place of performance of any portion of the offer covered by the Safety Precautions for Ammunition and Explosives clause contained in this solicitation after the date set for receipt of offers without the written approval of the Contracting Officer. The Contracting Officer shall grant approval only if there is enough time for the Government to perform the necessary safety reviews on the new proposed place of performance. (c) If a contract results from this offer, the Contractor agrees not to change any place of performance previously cited without the advance written approval of the Contracting Officer. The intent of this synopsis is to determine if any sources exist, and therefore, no Request for Quote (RFQ) is available. This notice of intent is not a request for competitive quotes; however, all information received by May 15, 2019 will be considered by the Government. A determination by the Government not to compete this proposed contract action based upon the responses received from this notice is solely within the discretion of the Government. STATEMENT OF WORK FOR ORDNANCE ASSESSMENT (OA) TESTING OF MARK (MK) 8 MODIFICATION (MOD) 0 EXPLOSIVE BOLTS 1. INTRODUCTION 1.1 Scope: This statement of work (SOW) defines the efforts to conduct non-destructive inspections, electrical tests, and destructive tests for eighty-five (85) Mark (Mk) 8 Modification (Mod) 0 Explosive Bolt Part Number (P/N) 6784421. Some of eighty-five (85) explosive bolts are Eurometaal P/N E333505, and some other of eighty-five (85) explosive bolts are Cartridge Actuated Device (CAD) Incorporated (Inc) P/N 056222-1. 2 APPLICABLE DOCUMENTS 2.1 Drawing: · Drawing No. 6784421, “Bolt, Explosive, Mk 8, Mod 0” 2.2 Specification: · Weapon Specification (WS) 33598, “Detail Specification, Item Specification For The Bolt, Explosive, Mk 8, Mod 0” 2.3 Test Procedure: · Document No. TP-373, “Surveillance Test Plan For Bolt, Explosive Mk 8 Mod 0” 2.4 Deviation / Waiver: · Deviation / Waiver No. F135314D009, “MK 8 MOD 0 Explosive Bolt - Shunt Resistance Reduction” 3 REQUIREMENTS 3.1 On-Site Visit and Coordination. Technical representatives from the Government will witness testing. The contractor shall provide the Government at least 21 calendar days advance notification prior to Non-destructive inspections and tests required in Section 3.4.6. In addition, the contractor shall provide the Government at least 21 calendar days advance notification prior to Destructive tests required in Section 3.4.7. 3.1.1 The contractor shall work with the Government to arrange reasonable accommodations. 3.1.2 If the technical representative specified in SOW Section 5 cannot witness testing on the dates provided by the contractor, but desired to witness the testing, the contractor shall reschedule the testing to allow for the technical representative specified in SOW Section 5 to attend. The Government will inform the contractor of the technical representative’s unavailability at least 14 calendar days prior to testing. 3.1.3 The contractor shall answer questions by the technical representatives about the test set ups and inspection/test techniques. 3.2 Government Furnished Materials (GFM). The Government will provide the contractor with eighty-five (85) explosive bolts as defined in Tables I and II. 3.3 Schedule. Function Firings shall be completed within 20 weeks after receipt of the contract and all Government Furnished Material (GFM). Testing shall be performed in accordance with CAD Inc TP-373 unless specified otherwise, and in accordance with the tests shown in Table III. If tests listed in Table III are not included in the contractor’s TP-373, tests shall be conducted in accordance with the contractor’s local instructions and with the drawings and specifications listed in Sections 2.1 and 2.2. The test order shown in Table III must be maintained throughout the test program. 3.4.1.1 The contractor has previously inspected and tested Mk 8 Mod 0 Explosive Bolt P/N 6784421, both Eurometaal P/N E333505 and CAD Inc P/N 056222-1 units, conducted in accordance with CAD Inc test plan TP-373, “Surveillance Test Plan for Bolt, Explosive, Mk 8 Mod 0” for BAE Systems. It is to the Government’s understanding that testing will be performed in accordance with the procedures specified in TP-373 unless specified otherwise. Shall there be a deviation from TP-373 in terms of inspection/test procedures, the contractor shall provide a detailed description of the variance to be used for testing, through Test Work Order in accordance with SOW Section 4.1 for CDRL A001. Contractor format is acceptable. In the event of a failure, the contractor shall be limited to verifying the test setup and taking post-test photograph and radiograph (x-ray) of the failed unit(s) alongside a successfully functioned unit. If possible, an unfired unit should also be included in the x-ray. If the unit(s) is Eurometaal bolt(s) P/N E333505, the contractor shall not take x-ray if determined cannot per SOW Section 3.4.6.3.4. The contractor shall retain any failed units for at least 45 days after test date or until released for disposition by the government representative, whichever occurs first. The contractor will document any failure(s) with a notification of anomaly (NOA). No unit shall be removed from further testing in accordance with Table III as the result of a failure, unless either the unit fired or the technical representative requested for it. 3.4.3 Skipping Inspections/Tests. Any time before or during the testing in SOW Section 3.4, the technical representative specified in SOW Section 5 may request to have any of units listed in Tables I and II to skip any inspections and tests specified in Table III. 3.4.4 Test Samples and Packaging Materials Returning to Government. Any time during or after the testing in SOW Section 3.4 until those units are released for disposition by the government representative, the technical representative specified in SOW Section 5 may request any of units listed in Tables I and II to be shipped back to NSWC/IHEODTD after the Function Firing test (SOW Sections 3.4.7.1 and 3.4.7.2) is completed. All packaging containers and supplies used by the Government to send the units to the contractor shall be returned to NSWC/IHEODTD with or without the units unless requested otherwise by the technical representative specified in in SOW Section 5. 3.4.5 Disposition of Test Samples. Upon Government acceptance of all CDRLs, the contractor shall dispose of fired test samples at their facility. 3.4.6 Non-Destructive Inspections and Electrical Tests. All test data shall be recorded. 3.4.6.1 Visual/Workmanship Inspection shall be conducted on all units in Table III in accordance with CAD Inc TP-373 unless specified otherwise, and the additional requirements in accordance with SOW Sections 3.4.6.1.1 and 3.4.6.1.2. 3.4.6.1.1 Units with damaged thread, which may affect the proper installation, shall be documented. 3.4.6.1.2 Units with damaged or torn electrical cables shall be documented. 3.4.6.2 Dimensional Inspection shall be conducted on all units in Table III in accordance with Drawing No. 6784421. Include actual measurements for the data. 3.4.6.3 Radiographic Examination shall be conducted on all units in Table III in accordance with CAD Inc TP-373 unless specified otherwise. Radiographic examination report and copy of X-ray(s) shall be provided. Units with visible damaged or torn cables shall be documented. 3.4.6.3.1 Government is not required to provide the drawings for Eurometaal unit. 3.4.6.3.2 Radiographic scans shall be conducted on all Eurometaal units unless specified otherwise, but the contractor is not required to examine and determine pass/fail result if the drawings of Eurometaal unit are not provided. 3.4.6.3.3 Government may provide assistance with examining the X-ray(s) of Eurometaal units if permissible. 3.4.6.3.4 If the Government and/or contractor determines to not have the contractor conduct radiographic examination or scans on Eurometaal units, an explanation for exempting Eurometaal units from the radiographic examination or scan shall be documented. The copy of written explanation shall be provided to Government with Test Data package (CDRL A002). 3.4.6.4 Bridge/Shunt/Shield Resistances shall be conducted on all units in Table III in accordance with CAD Inc TP-373 unless specified otherwise. Include actual measurements for the data. 3.4.6.4.1 Determining pass or failure condition of the actual measurement value for each CAD Inc unit shall be based on the recommended acceptance value of shunt resistance specified in accordance with the Deviation F135314D009. Include actual measurements for the data. 3.4.6.5 Insulation Resistance shall be conducted on all units in Table III in accordance with CAD Inc TP-373 unless specified otherwise. Include actual measurements for the data. 3.4.6.6 Electrostatic Discharge shall be conducted on all Groups A and C units in Table III in accordance with CAD Inc TP-373 unless specified otherwise. Include ESD pulse charts for the data if available. 3.4.6.7 If six (6) unit failures occur during a single test in SOW Section 3.4.6 and those failures resulted in permanent loss of units (e.g. fired or became dud as the direct result of test), the contractor shall terminate the test and move on to the next test/inspection with remaining units. The contractor shall document any failure(s) with a notification of anomaly (NOA). 3.4.6.7.1 Unit(s) that have damaged threads and/or cables, but have intact cartridge assembly remaining operational (unfired), are not considered as permanent-loss failures in accordance with SOW Section 3.4.6.7. 3.4.6.8 Photographs shall be taken of all anomalies, failures, test setups, and pre-test units. 3.4.6.9 Each anomaly/failure shall be documented and described. 3.4.7 Destructive Tests. All test data shall be recorded. 3.4.7.1 Function Firing (at +34°F) shall be conducted at +34°F on all Groups A and B units in Table III in accordance with CAD Inc TP-373 unless specified otherwise. If a unit cannot fit in any of test fixture(s) as specified in CAD Inc TP-373 due to damaged thread, Alternative Function Firing (at +34°F) shall be conducted on the unit in accordance with SOW Section 3.4.7.1.1 (only if CAD Inc TP-373 cannot be used on this unit). 3.4.7.1.1 Alternative Function Firing (at +34°F) shall be conducted at +34°F on unit(s) in accordance with CAD Inc TP-373, except the test fixture specified by CAD Inc TP-373 is not required. In addition, a monitoring and recording method may be provided in place of separation time measuring instrument(s) that required the test fixture specified by CAD Inc TP-373. Procedure for Alternative Function (at +34°F) shall be provided through Test Work Order in accordance with SOW Section 4.1 for CDRL A001. 3.4.7.2 Function Firing (at +90°F) shall be conducted at +90°F on all Group C units in Table III in accordance with CAD Inc TP-373 unless specified otherwise. If a unit cannot fit in any of test fixture(s) as specified in CAD Inc TP-373 due to damaged thread, Alternative Function Firing (at +90°F) shall be conducted on the unit in accordance with SOW Section 3.4.7.2.1 (only if CAD Inc TP-373 cannot be used on this unit). 3.4.7.2.1 Alternative Function Firing (at +90°F) shall be conducted at +90°F on bolt(s) in accordance with CAD Inc TP-373, except the test fixture specified by CAD Inc TP-373 is not required. In addition, a monitoring and recording method may be provided in place of separation time measuring instrument(s) that required the test fixture specified by CAD Inc TP-373. Procedure for Alternative Function (at +90°F) shall be provided through Test Work Order in accordance with SOW Section 4.1 for CDRL A001. 3.4.7.3 Photographs shall be taken of all anomalies, failures, test setups, and pre- & post-fired units. 3.4.7.4 Those following shall be documented for Function Firings and Alternative Function Firings, SOW Sections 3.4.7.1 and 3.4.7.2: Temperature and humidity of the bay the function firing conducts in, date and time of test, torque measurement (if torqued into a test fixture), trace charts of currents with time if applicable, bolt separation time, bridgewire burn time, and test equipment used and calibration dates. 3.4.7.5 Full billing may be submitted upon submittal of all destructive test data in accordance with SOW Section 4.3 for CDRL A003. 4 DELIVERABLES 4.1 Test Work Order (CDRL A001). A copy of the work order(s) detailing the procedures for Non-Destructive Inspections, Electrical Tests, and Destructive Tests, listed in Table III and in accordance with SOW Sections 3.4.6 and 3.4.7, and any detailed description of variance(s) to CAD Inc TP-373 in accordance with SOW Section 3.4.1.1 shall be provided for Government review/approval at least 21 days prior to the start of testing. Contractor format is acceptable. 4.2 Test Data, Nondestructive (CDRL A002). A copy of all non-destructive inspection results, electrical test results, test equipment list and calibration information, any conditioning chamber temperature profiles, x-rays, pulse charts, and photographs shall be provided to NSWC/IHEODTD within 5 days of completion of non-destructive inspections and electrical tests and at least 1 day prior to destructive testing. A notification of anomaly (NOA) shall be provided for any unit that does not meet the non-destructive or electrical test requirements. A copy shall also be provided to the technical representative specified in SOW Section 5 when the technical representative visit on-site for witness prior to destructive testing. Contractor format is acceptable. 4.3 Technical Report- Study/Services (CDRL A003). First Submission - A copy of destructive test results and associated current and time traces, test equipment list and calibration information, and any conditioning chamber temperature profiles shall be provided to NSWC IHEODTD within 10 days of completion of destructive testing. A notification of anomaly shall be provided for any unit that does not meet the destructive test requirements. Contractor format is acceptable. Second Submission - Final report and electronic copies of current and time traces in a digital file format compatible with MS Excel (e.g. .csv or .xls files) and photographs shall be provided to NSWC IHEODTD within 30 days of completion of destructive testing. Contractor format is acceptable. 4.4 Summary. Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are: 1) W, Lease/Rental of Equipment; 2) X, Lease/Rental of Facilities; 3) Y, Construction of Structures and Facilities; 4) D, Automatic Data Processing and Telecommunications, IT and Telecom-Telecommunications Transmission (D304) and Internet (D322) ONLY; 5) S, Utilities ONLY; 6) V, Freight and Shipping ONLY. The Contractor is required to completely fill in all required data fields using the following web address www.ecmra.mil Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are: 1) W, Lease/Rental of Equipment; (2) X, Lease/Rental of Facilities; (3) Y, Construction of Structures and Facilities; 4) D, Automatic Data Processing and Telecommunications, IT and Telecom- Telecommunications Transmission (D304) and Internet (D322) ONLY; (5) S, Utilities ONLY; (6) V, Freight and Shipping ONLY. The Contractor is required to completely fill in all required data fields using the following web address https://doncmra.nmci.navy.mil. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year.
