AWARD of BASIC ORDERING AGREEMENT (BOA) MK38 MOD 3 - BAE LAND SYSTEMS & ARMAMENTS The Naval Surface Warfare Center, Indian Head Division (NSWC IHD) – Picatinny Detachment, awarded a Firm Fixed Price, Supply contract on a Sole Source (SS) basis to BAE Systems Land & Armaments, Inc. to support the MK38 MOD 3 Machine Gun Systems (MGS) including Open, Inspect and Repair efforts, Engineering Services, Linux Operating System Upgrades, Mod2 to Mod3 Conversion Kits and associated hardware, and spares. It is anticipated that this contract will be awarded to support the FY23 through FY27 requirements with a 5 year ordering period. The five-year BOA will be pursued under the authority of this Class Justification and Approval (CJ&A). The proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1. This Solicitation will be restricted under 10 U.S.C. SS 3204 (a) (1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1(a)(2); Only one responsible source and no other supplies or services will satisfy agency requirements.
