This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. II. Solicitation number is issued as a request for proposal (RFP). III. Solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2019-06 Item I, Effective 10 September 2019, DPN 20190913 (Effective 13 September 2019), and NMCARS 2018 Edition, Current to 18-08 (Effective: 6 Sept 2019). IV. The North American Industry Classification Systems Code (NAICS) for this solicitation is 334516 and the associated small business size is 1,000 employees. The associated Federal Supply Code (FSC)/Product Service Code (PSC) is 6685. V. A list of line item number(s) and items, quantities, and units of measure, to be procured on a brand name or equal basis, in accordance with FAR 52.211-6 Brand Name or Equal (Aug 1999) VI. The Naval Research Laboratory (NRL) intends to award a Firm-Fixed-Price (FFP) contract for delivery and installation of the Brand Name or Equal items listed in the table above. Complete description, specification, and salient characteristics of the required items are provided in Attachment 1 of this solicitation. VII. Delivery and Acceptance: DELIVERY SHALL BE FOB DESTINATION, Free of expense to the Government, in accordance with FAR 52.247-34. Delivery and acceptance is at The Naval Research Laboratory. 4555 Overlook Ave. SW, Washington, DC 20375. FOB DESTINATION MEANS: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery Delivery is FOB Destination. Delivery and acceptance is at NRL, Washington, D.C. 20375. Specific delivery/installation location at NRL - Washington will be provided at the time of Contract Award. VIII FAR 52.212-1, INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (Oct 2018) (DEVIATION 2018-O0018)) and addenda and tailoring apply to this acquisition FAR 52.212-1 has been tailored to include the following additional instructions: a) This procurement is for new equipment ONLY, unless otherwise specifically stated. No remanufactured or "gray market" items are acceptable. All equipment must be covered by the manufacturer's warranty. b) Vendor shall be an Original Equipment Manufacturer (OEM) authorized dealer, authorized distributor, or authorized reseller for the proposed equipment/system such that OEM warranty and service are provided and maintained by the OEM. All software licensing, warranty, and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. c) Offerors are required to submit documentation from the manufacturer stating that they are an authorized distributor for the specific items being procured. d) General statements, that the offeror can or will comply with the requirements, that standard procedures will be used, that well known techniques will be used, or that paraphrases the RFP's specifications in whole or in part, will not constitute compliance with the mandatory requirements concerning the content of the technical proposal. e) ELECTRONIC AND INFORMATION TECHNOLOGY (EIT)- In accordance with Section 508 of the Rehabilitation Act of 1973 (29 USC 794d), all EIT supplies and services provided under this contract must comply with the applicable accessibility standards issued by the Architectural and Transportation Barriers Compliance Board at 36 CFR part 1194 (see FAR Subpart 39.2). Any changes provided by the offeror are applicable to this solicitation only, and do not result in an update to the representations and certifications posted on SAM. Addendum to FAR 52.212-1 Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers. IX. FAR 52.212-2 EVALUATION - COMMERCIAL ITEMS (OCT 2014) is applicable to this acquisition. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) Technical capability/acceptability of the item offered to meet the Government requirement; and Technical capability/acceptability is defined as meeting or exceeding all the Government's required specifications, delivery schedule, and any other terms and conditions specified in this solicitation and its attachment(s). For the purpose of evaluation of Technical Capability/Acceptability: Documentation that confirms (1) the proposed solution is capable of meeting and/or exceeding all the Government's required specifications the offeror is capable of providing the equipment specified in the statement of work, shall be provided. Offeror shall include a copy of the quoted system's manufacturer's specifications. (2) General statements, that the offeror can or will comply with the requirements, that standard procedures will be used, that well known techniques will be used, or that paraphrases the RFP's specifications in whole or in part, will not constitute compliance with the mandatory requirements concerning the content of the technical proposal. (ii) Price; (iii) Past Performance. (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
