Pursuant to 10 U.S.C. 2304(c)(1) as implemented by Federal Acquisition Regulation 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, the Government intends on soliciting and awarding a sole source Indefinite Delivery, Indefinite Quantity (IDIQ) contract for the procurement of up to 116,640 pounds of the NXA5126 rubber compound to Burke Industries, Incorporated, 2250 S 10th Street, San Jose, CA 95112-4114. The intended ordering period of the IDIQ is five years. Based on market research, Burke Industries is only source capable of producing the NXA5126 as it developed the exact formulation of NXA5126, owns the rights to the formulation, and no other source has the capability to produce the NXA5126 within the timeframe to meet the Navy's operational needs without resulting in unacceptable delays. Interested sources may identify their interest and capability to meet the Government's requirements by the closing time/date. This notice is not a request for proposals nor shall it be construed as a commitment by the Government to solicit contractual offers or award contracts. The Government will not reimburse the cost from any interested source for this announcement.
