N0016420Q0127 - SOLE SOURCE – REPAIR– KEYSIGHT TEST EQUIPMENT – QTY 1 EACH/CLIN PSC J099 - NAICS 811219 ISSUE DATE 19 AUG 2020 CLOSING DATE 21 AUG 2020 - 4:00 PM Eastern Time ITEM DESCRIPTION- Naval Surface Warfare Center (NSWC) Crane has a requirement for the repair of the following; CLIN 0001 - Power Sensor, P/N E4413A, QTY 1 Each CLIN 0002 - Power Sensor, P/N E4413A, QTY 1 Each CLIN 0003 - Spectrum Analyzer, P/N E4440A, QTY 1 Each CLIN 0004 - Oscilloscope, P/N DSO9104A, QTY 1 Each CLIN 0005 - Signal Analyzer, P/N N9030A, QTY 1 Each CLIN 0006 - Spectrum Analyzer, P/N 8563E, QTY 1 Each The Government intends to solicit and award a single Firm-Fixed-Price (FFP) Sole Source, contract IAW FAR 13. The proposed contract action is for the supplies for which the Government intends to solicit and negotiate with one source, Keysight Technologies, Inc., 1900 Garden of the Gods Rd., Colorado Springs, CO 80907-3423 Cage Code: 7ZXR5. The basis for restricting competition is the substantial duplication of costs to the Government to qualify another manufacturer’s product, which are not anticipated to be recouped through competition, and the anticipated unacceptable delays in fulfilling the agency requirements through any other source. Keysight Technologies, Inc.is currently the only manufacturer of this equipment. Keysight Technologies, Inc retains all intellectual property rights to the design and is considered the only responsible source possessing sufficient requisite knowledge, engineering expertise, and technical data to repair the aforementioned test equipment. All responsible sources may submit a capability statement which shall be considered by the agency. However, a determination by the Government not to compete with this proposed contract based upon responses to this solicitation is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This solicitation is being issued pursuant to the procedures at FAR Part 13. Synopsis exception FAR 5.202(a)(13) applies and Solicitation Number N0016420Q0127 is hereby issued as an attachment hereto. All changes that occur prior to the closing date of this solicitation/synopsis will be posted to the https://beta.SAM.gov website.
