Naval Air Systems Command (NAVAIR), NAS Patuxent River, MD, intends to negotiate and award a Firm Fixed Price contract modification on a sole source basis to BAE Systems, Austin, Texas for the FY24-FY26 production and repair of Digital Control Display Units (DCDU). The contract action will procure best estimated quantities of 13 DCDUs and 22 repairs each year. The anticipated award date is December 2024. The proposed contract action for which the Government intends to solicit and negotiate with only one source under the authority of 10 U.S.C.3204(a)(1) and FAR 6.302-1, “Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency Requirements.”. BAE Systems Information & Electronic Systems Integration Inc. is the sole designer, developer, and manufacturer of the AN/ALE-47 CMDS, which includes the AN/ALE-47 DCDU. These items were developed exclusively at BAE Systems private expense and BAE Systems is not willing to offer the data rights for sale suitable for competition in this case. At this time, there are no other contractors able to meet the U.S. Government requirements to produce or repair these DCDUs. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. Interested parties, however, may identify their interest and capability by responding to the requirement. The Government will consider all information received prior to the closing date of this synopsis. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete the proposed contract modification based upon responses to this notice is solely within the discretion of the Government.
