The Naval Air Systems Command (NAVAIR) intends to solicit and negotiate a Firm-Fixed Price (FFP), sole source Delivery Order under a Basic Ordering Agreement (BOA) contracting vehicle with BAE Systems, Information and Electronic Systems (BAE), Nashua, NH. BAE shall repair a failed EDM Power Divider, as well as develop and deliver technical data to support documentation of the Software build environment, resources, and processes. BAE Systems is the original designer, developer, and manufacturer of the OE-120()/UPX Antenna Group systems, therefore they are the only firm that possesses the unique knowledge, experience, special skills, facilities, manufacturing techniques, and technical data required to satisfy these requirements. This acquisition is being pursued on a sole source basis under the statutory authority of 10 U.S.C 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.” The Government does not intend to use the provisions of FAR part 12 for this acquisition.
